Presiding officers, sessions and parliamentary devices
The Speaker and the Chairman, how sessions are summoned and ended, quorum and voting, joint sittings, Question Hour and Zero Hour, and the motions that test the government's confidence.
(→ English: Council of Ministers · हिन्दी: मंत्रिपरिषद)

| No-confidence motion | Censure motion | Adjournment motion | |
|---|---|---|---|
| Reasons stated | Not needed | Must be stated | A definite matter of urgent public importance |
| Aimed at | The whole Council of Ministers | One minister, a group or the whole government | The government's handling of the matter |
| Can it remove the government? | Yes, if passed in the Lok Sabha | No legal effect of that kind | No |
| If passed | The whole Council of Ministers must resign | No legal duty to resign | Treated as a censure of the government |
Exam traps
- The Speaker resigns by writing to the Deputy Speaker, not to the President.
- While a resolution to remove him or her is considered, the Speaker may still vote in the first instance; the Chairman of the Rajya Sabha cannot vote at all.
- Quorum is one-tenth of the total number of members of the House, and the count includes the presiding officer.
- A joint sitting is presided over by the Speaker, not by the Chairman of the Rajya Sabha, and is not available for Money Bills or Constitution Amendment Bills.
- Prorogation ends a session but does not make pending bills lapse; only dissolution of the Lok Sabha does.
- Question Hour is in the Rules of Procedure; Zero Hour is not.
- A no-confidence motion needs no reasons; a censure motion must state reasons. Neither the no-confidence motion nor the adjournment motion can be moved in the Rajya Sabha.
Recap
- Article 118: each House makes its own rules of procedure; much of parliamentary practice lives there.
- Speaker (Articles 93–96): elected by the Lok Sabha; removal by a majority of all the then members after 14 days' notice; certifies Money Bills; presides over joint sittings; office continues after dissolution.
- Chairman of the Rajya Sabha: the Vice-President ex officio; casting vote only; cannot vote at all while his or her removal is considered (Article 92).
- Article 85: no more than six months between sessions; prorogation ends a session, dissolution ends the Lok Sabha.
- Article 100: decisions by majority present and voting; quorum one-tenth. Article 120: Hindi or English, mother tongue with permission.
- Joint sitting (Article 108): only for ordinary bills; Speaker presides; held in 1961, 1978 and 2002.
- Question Hour: starred (oral, supplementaries), unstarred (written), short notice. Zero Hour: not in the rules.
- No-confidence and adjournment motions: Lok Sabha only, 50 members; censure motion needs reasons; calling attention motion since 1954.
Practice questions
Q1. Consider the following statements about the Speaker of the Lok Sabha:
1. The Speaker can be removed by a resolution passed by a majority of all the then members of the Lok Sabha.
2. The Speaker vacates office as soon as the Lok Sabha is dissolved.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct (Article 94(c)). Statement 2 is wrong: on dissolution the Speaker remains in office until immediately before the first meeting of the new Lok Sabha. So '2 only', 'both' and 'neither' are wrong.
Q2. Who presides over a joint sitting of the two Houses of Parliament?
- The President
- The Vice-President, as Chairman of the Rajya Sabha
- The Speaker of the Lok Sabha
- The senior-most member of either House
Show answer
Answer: C. The Speaker of the Lok Sabha
Article 118(4) gives the chair to the Speaker; in the Speaker's absence the Deputy Speaker, and then the Deputy Chairman of the Rajya Sabha. The President summons the joint sitting but does not preside; the Chairman of the Rajya Sabha has no role in presiding over it; seniority does not decide the chair.
Q3. A joint sitting of Parliament under Article 108 CANNOT be held on which of the following?
1. A Money Bill
2. A Constitution Amendment Bill
3. An ordinary bill rejected by the Rajya Sabha after the Lok Sabha passed it
Select the correct answer using the code given below.
- 1 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 2 only
A Money Bill cannot be deadlocked because the Rajya Sabha cannot reject it, and a Constitution Amendment Bill must be passed by each House separately under Article 368. An ordinary bill rejected by the other House is exactly the case Article 108 covers, so any option containing 3 is wrong, and '1 only' leaves out the amendment bill.
Q4. The quorum to constitute a meeting of either House of Parliament is
- one-tenth of the total number of members of the House
- one-fourth of the members present
- one-third of the total number of members of the House
- a majority of the total number of members of the House
Show answer
Answer: A. one-tenth of the total number of members of the House
Article 100(3) fixes the quorum at one-tenth of the total number of members of the House, including the presiding officer. The other fractions are not in the Constitution; a majority of the total membership is relevant to special majorities, not quorum.
Q5. Consider the following statements about Zero Hour:
1. It is provided for in the Rules of Procedure and Conduct of Business in Lok Sabha.
2. It follows the Question Hour.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 2 is correct. Statement 1 is wrong: Zero Hour is an Indian practice that is not mentioned in the Rules of Procedure. So '1 only', 'both' and 'neither' are wrong.
Q6. Which one of the following can be moved only in the Lok Sabha?
- A no-confidence motion
- A calling attention motion
- A motion of thanks on the President's address
- A starred question
Show answer
Answer: A. A no-confidence motion
The Council of Ministers is responsible to the Lok Sabha (Article 75(3)), so only that House can express no confidence in it. Calling attention motions, motions of thanks and starred questions are used in both Houses.
Q7. Consider the following statements about Article 120:
1. Business in Parliament shall be transacted in Hindi or in English.
2. The presiding officer may permit a member who cannot adequately express himself or herself in Hindi or English to address the House in his or her mother tongue.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: C. Both 1 and 2
Both statements restate Article 120(1). So '1 only', '2 only' and 'neither' are wrong.
Q8. Which of the following bills were passed at a joint sitting of Parliament?
1. The Dowry Prohibition Bill, 1961
2. The Prevention of Terrorism Bill, 2002
3. The Constitution (Forty-fourth Amendment) Bill, 1978
Select the correct answer using the code given below.
- 1 and 2 only
- 2 and 3 only
- 1 and 3 only
- 1, 2 and 3
Show answer
Answer: A. 1 and 2 only
The three joint sittings were on the Dowry Prohibition Bill (1961), the Banking Service Commission (Repeal) Bill (1978) and the Prevention of Terrorism Bill (2002). A Constitution Amendment Bill can never go to a joint sitting, so every option containing 3 is wrong.
