Composition, membership and anti-defection
How the Lok Sabha and Rajya Sabha are made up, how long they last, who can become a member, and how a member loses the seat: vacation, disqualification, conviction and the Tenth Schedule.

Exam traps
- The President is a part of Parliament (Article 79) but not a member of either House.
- The Constitution says one-third of the Rajya Sabha retires every second year; the six-year term of a member comes from the Representation of the People Act, 1951.
- Minimum age: 25 for the Lok Sabha, 30 for the Rajya Sabha. Do not mix these up with 35 for the President.
- Disqualification under Article 102(1) (office of profit and the like) is decided by the President on the binding opinion of the Election Commission (Article 103). Defection cases under the Tenth Schedule are decided by the Speaker or Chairman.
- Only a merger agreed to by two-thirds of the members escapes the anti-defection law. The one-third 'split' exception was deleted by the 91st Amendment (2003).
- A nominated member may join a party within six months of taking the seat; an independent member may never join one.
- Lok Sabha seats among States are still based on the 1971 census (frozen until the first census after 2026 by the 84th Amendment), not on the 2011 census.
Recap
- Article 79: Parliament = President + Rajya Sabha + Lok Sabha.
- Rajya Sabha: not more than 250 (12 nominated); elected by elected MLAs by single transferable vote; permanent, one-third retire every two years.
- Lok Sabha: not more than 530 + 20 by direct election; five-year term; seat allocation frozen on the 1971 census; Anglo-Indian nomination ended in 2020.
- Qualifications (Article 84): citizen, oath, age 25 (Lok Sabha) or 30 (Rajya Sabha); more added by the Representation of the People Act, 1951.
- Vacation of seats (Article 101): no double membership; resignation must be voluntary and genuine; sixty days' absence.
- Disqualification (Article 102): office of profit, unsound mind, insolvency, foreign citizenship, law of Parliament; President decides on the Election Commission's opinion (Article 103).
- Conviction with two years' imprisonment disqualifies; Lily Thomas (2013) removed the shield for sitting members.
- Tenth Schedule (52nd Amendment, 1985): presiding officer decides, subject to judicial review (Kihoto Hollohan, 1992); merger needs two-thirds; split exception deleted (91st Amendment, 2003).
Practice questions
Q1. Consider the following statements about the Rajya Sabha:
1. It is not subject to dissolution.
2. The six-year term of its members is laid down in the Constitution.
3. Members representing a State are elected by the elected members of that State's Legislative Assembly.
Which of the statements given above are correct?
- 1 and 2 only
- 1 and 3 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 3 only
Statement 1 is correct (Article 83(1)). Statement 3 is correct (Article 80(4)). Statement 2 is wrong: the Constitution only says one-third retire every second year; the six-year term is fixed by the Representation of the People Act, 1951. So options with statement 2 are wrong.
Q2. A question arises whether a sitting member of the Lok Sabha holds an office of profit under the Government of India. Who decides it?
- The Speaker of the Lok Sabha
- The President, acting according to the opinion of the Election Commission
- The Supreme Court, under its original jurisdiction
- The Election Commission, without reference to anyone
Show answer
Answer: B. The President, acting according to the opinion of the Election Commission
Article 103: questions about disqualification under Article 102(1) go to the President, whose decision is final, but who must obtain and act on the Election Commission's opinion. The Speaker decides only defection cases under the Tenth Schedule; the Supreme Court has no original jurisdiction here; the Election Commission only gives an opinion.
Q3. Under the Tenth Schedule, which one of the following does NOT lead to disqualification?
- An independent member joins a political party after the election
- A nominated member joins a political party four months after taking the seat
- A party member votes against the party's direction without permission, and the party does not condone it
- A party member voluntarily gives up membership of the party
Show answer
Answer: B. A nominated member joins a political party four months after taking the seat
A nominated member may join a party within six months of taking the seat, so joining after four months is allowed. An independent member is disqualified on joining any party; voting against the party direction without permission, if not condoned within 15 days, and voluntarily giving up membership are both grounds of disqualification.
Q4. What did the Supreme Court hold in Kihoto Hollohan v. Zachillhu (1992)?
- The Tenth Schedule is wholly unconstitutional
- The presiding officer's decision on defection is subject to judicial review
- Defection cases must be decided by the Election Commission
- A one-third split of a legislature party is always protected
Show answer
Answer: B. The presiding officer's decision on defection is subject to judicial review
The Court upheld the Tenth Schedule but struck down paragraph 7, which barred the courts, so the Speaker's or Chairman's decision can be reviewed. The Schedule was not struck down as a whole; the Election Commission has no role in defection cases; and the split exception was later deleted by the 91st Amendment (2003), not made permanent.
Q5. Consider the following statements about the term of the Lok Sabha during a Proclamation of Emergency:
1. Parliament may extend it by law for not more than one year at a time.
2. The extension cannot continue beyond six months after the Proclamation has ceased to operate.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: C. Both 1 and 2
Both follow the proviso to Article 83(2): extension by law, one year at a time, and in no case beyond six months after the Proclamation ceases. So '1 only', '2 only' and 'neither' are wrong.
Q6. Consider the following pairs:
1. 52nd Amendment (1985) — added the Tenth Schedule
2. 91st Amendment (2003) — deleted the one-third split exception
3. 84th Amendment (2001) — ended the nomination of Anglo-Indians to the Lok Sabha
4. 33rd Amendment (1974) — resignation accepted only if voluntary and genuine
How many of the pairs given above are correctly matched?
- Only one
- Only two
- Only three
- All four
Show answer
Answer: C. Only three
Pairs 1, 2 and 4 are correct. Pair 3 is wrong: the 84th Amendment extended the freeze on seat allocation to the first census after 2026; Anglo-Indian nomination was ended by the 104th Amendment (2019). So only three pairs match.
Q7. In Lily Thomas v. Union of India (2013), the Supreme Court struck down which provision?
- Section 8(4) of the Representation of the People Act, 1951
- Paragraph 7 of the Tenth Schedule
- Article 331 of the Constitution
- Section 3 of the Representation of the People Act, 1951 on domicile
Show answer
Answer: A. Section 8(4) of the Representation of the People Act, 1951
Section 8(4) let convicted sitting members keep their seats while an appeal filed within three months was pending; the Court struck it down. Paragraph 7 was struck down in Kihoto Hollohan (1992); Article 331's nomination ended by the 104th Amendment; and the 2003 change to the domicile rule was upheld, not struck down, in Kuldip Nayar (2006).
Q8. The allocation of Lok Sabha seats among the States is at present based on which census?
- 1951
- 1971
- 2001
- 2011
Show answer
Answer: B. 1971
The 42nd Amendment (1976) froze the allocation on the 1971 census, and the 84th Amendment (2001) extended the freeze until the first census taken after 2026. The 1951 census was used only at the start; 2001 and 2011 have not been used to reallocate seats among States.
