Written with AI from the sources listed at the bottom of this page, then fact-checked by a separate AI.

The Speaker and the Chairman, how sessions are summoned and ended, quorum and voting, joint sittings, Question Hour and Zero Hour, and the motions that test the government's confidence.

Each idea is explained first in Kannada (ಕನ್ನಡ), ending with the English and Hindi exam terms, followed by the same point in exam English. UPSC Prelims is in English or Hindi, so understand it in Kannada and revise it in English.

In exam EnglishPart 1 described who sits in Parliament. This part explains how the Houses work: who presides, when they meet, how many members must be present, how a deadlock over a bill is settled, and the tools members use to hold the government to account. These tools matter because under Article 75(3) the Council of Ministers is collectively responsible to the Lok Sabha: the government survives only while it keeps the House's confidence, and questions, debates and motions are how that confidence is tested day by day. Most procedural details are not in the Constitution itself. Article 118 lets each House make rules to regulate its procedure and the conduct of its business, so many devices discussed here come from the Rules of Procedure and Conduct of Business of each House, and one of them, Zero Hour, is not in the rules at all.

In exam EnglishThe Speaker and the Deputy Speaker are elected by the Lok Sabha from among its members (Article 93). The Speaker vacates office on ceasing to be a member, may resign by writing to the Deputy Speaker, and can be removed by a resolution passed by a majority of all the then members of the House, moved after at least 14 days' notice (Article 94). While such a resolution is under consideration, the Speaker does not preside but may speak, and may vote in the first instance though not when votes are equal (Article 96). When the House is dissolved, the Speaker does not vacate office until just before the first meeting of the new House, so the office is never empty. The Speaker's powers include deciding whether a bill is a Money Bill, a decision that is final (Article 110(3)); presiding over a joint sitting (Article 118(4)); and deciding defection cases under the Tenth Schedule. Ordinarily the Speaker does not vote, but has a casting vote in a tie (Article 100). After a general election a pro tem Speaker, appointed by the President and usually a senior member, administers the oath to new members and presides until the Speaker is elected.

In exam EnglishThe Rajya Sabha is presided over by its Chairman, who is the Vice-President of India acting ex officio (Articles 64 and 89); the House elects a Deputy Chairman from among its members. Because the Chairman is not a member of the Rajya Sabha, he or she does not vote in the first instance and has only a casting vote in a tie. The Chairman can be removed only by removing the Vice-President: a resolution of the Rajya Sabha passed by a majority of all its then members and agreed to by the Lok Sabha, after at least 14 days' notice (Article 67(b)). Note one difference from the Speaker: while a resolution for his or her removal is under consideration, the Chairman may speak in the House but is not entitled to vote at all (Article 92). Like the Speaker, the Chairman decides defection cases for the Rajya Sabha. Each House also keeps a panel of members, nominated by its presiding officer, who preside when both the presiding officer and the deputy are absent.

In exam EnglishArticle 85 says the President shall from time to time summon each House to meet, but six months must not pass between its last sitting in one session and the date of its first sitting in the next, so each House must meet at least twice a year. By convention there are three sessions: the Budget session (roughly February to May), the Monsoon session (roughly July to September) and the Winter session (roughly November to December). Three different acts bring work to a halt. Adjournment, by the presiding officer, suspends a sitting for hours or days; adjournment sine die ends a sitting without fixing a day for the next. Prorogation, by the President, ends the session itself, but bills pending before the House do not lapse. Dissolution, also by the President, ends the life of the Lok Sabha; the Rajya Sabha is never dissolved. On dissolution, a bill pending in the Lok Sabha, or passed by it and pending in the Rajya Sabha, lapses. A bill pending in the Rajya Sabha that the Lok Sabha has not passed does not lapse, nor does a bill for which the President has notified a joint sitting before the dissolution (Article 108(5)).

In exam EnglishUnder Article 100, questions in each House are decided by a majority of the members present and voting, other than the presiding officer, and the quorum is one-tenth of the total number of members of the House, counting the presiding officer. If at any time there is no quorum, the presiding officer must adjourn the House or suspend the sitting until there is one. Article 87 requires the President to address both Houses assembled together at the start of the first session after each general election to the Lok Sabha and at the start of the first session of each year; each House then debates a motion of thanks on the address, and its defeat in the Lok Sabha would signal that the government has lost the House's confidence. Article 88 gives every minister and the Attorney General the right to speak in and take part in the proceedings of either House, a joint sitting, or a committee they are named to, but this article gives them no right to vote. Under Article 120, business is transacted in Hindi or English, but the presiding officer may permit a member who cannot adequately express himself or herself in either to address the House in his or her mother tongue.

In exam EnglishA joint sitting under Article 108 settles a deadlock on an ordinary bill. After a bill passed by one House reaches the other, the President may call the Houses to a joint sitting if the other House rejects it, or the Houses finally disagree on amendments, or more than six months pass from the bill's receipt without the other House passing it. The Speaker presides (Article 118(4)); in his or her absence, the Deputy Speaker, and if both are absent, the Deputy Chairman of the Rajya Sabha. The bill is passed if a majority of the total number of members of both Houses present and voting agree. Since the Lok Sabha has more than twice as many members, its view usually prevails. There is no joint sitting for a Money Bill, because the Rajya Sabha cannot reject one, nor for a Constitution Amendment Bill, which each House must pass separately by a special majority under Article 368. Joint sittings have been held only three times: on the Dowry Prohibition Bill (1961), the Banking Service Commission (Repeal) Bill (1978) and the Prevention of Terrorism Bill (2002).

In exam EnglishThe Question Hour is normally the first hour of a sitting, when members ask ministers questions. A starred question, marked with an asterisk, is answered orally on the floor, and supplementary questions may follow. An unstarred question receives a written answer, so no supplementaries can be asked. A short notice question deals with a matter of urgent public importance, can be asked at shorter notice than an ordinary question, and is answered orally. The Zero Hour follows the Question Hour. It is an Indian innovation that grew out of practice and is not mentioned in the Rules of Procedure: members raise urgent matters without the usual notice, with the presiding officer's permission. For example, if a bridge collapses in a constituency the night before, its member may raise the matter in Zero Hour the next day, while a detailed starred question on bridge safety would need prior notice. Because ministers must answer in public and on record, these devices are among the most direct ways in which the House holds the executive accountable.

In exam EnglishMotions test the government's standing more directly. A no-confidence motion can be moved only in the Lok Sabha, needs the support of at least 50 members to be taken up, need not state reasons, and if passed obliges the whole Council of Ministers to resign; the Constitution does not name it, and it rests on Article 75(3) and the Lok Sabha's rules. A censure motion must state the reasons, can be aimed at a single minister, a group of ministers or the whole government, and its passage does not by itself compel the government to resign, though it is a serious political blow. An adjournment motion sets aside the normal business of the Lok Sabha to discuss a definite matter of urgent public importance; it also needs the support of 50 members, cannot be moved in the Rajya Sabha, and is regarded as carrying an element of censure of the government. A calling attention motion lets a member draw a minister's attention to an urgent matter and seek an authoritative statement; it is another Indian innovation, part of the rules since 1954. The motion of thanks on the President's address, described above, completes the main set.

In exam EnglishSeen together, these rules explain how a parliamentary government is kept answerable. The presiding officers keep order and settle disputed questions such as whether a bill is a Money Bill and whether a member has defected; the six-month rule and the President's annual address keep Parliament meeting regularly; quorum and majority voting make decisions legitimate; the joint sitting breaks deadlocks on ordinary bills; and questions, Zero Hour and motions make ministers explain themselves in public. Remember the asymmetry between the Houses: only the confidence of the Lok Sabha decides whether a government survives, which is why the no-confidence motion and the adjournment motion exist only there, while the Rajya Sabha, which cannot remove a government, questions and debates it. The next part turns to law-making itself: ordinary bills, Money Bills and financial bills, the President's assent, and the Budget.

Recap

Practice questions

Q1. Consider the following statements about the Speaker of the Lok Sabha:
1. The Speaker can be removed by a resolution passed by a majority of all the then members of the Lok Sabha.
2. The Speaker vacates office as soon as the Lok Sabha is dissolved.
Which of the statements given above is/are correct?

  1. 1 only
  2. 2 only
  3. Both 1 and 2
  4. Neither 1 nor 2
Show answer

Answer: A. 1 only

Statement 1 is correct (Article 94(c)). Statement 2 is wrong: on dissolution the Speaker remains in office until immediately before the first meeting of the new Lok Sabha. So '2 only', 'both' and 'neither' are wrong.

Q2. Who presides over a joint sitting of the two Houses of Parliament?

  1. The President
  2. The Vice-President, as Chairman of the Rajya Sabha
  3. The Speaker of the Lok Sabha
  4. The senior-most member of either House
Show answer

Answer: C. The Speaker of the Lok Sabha

Article 118(4) gives the chair to the Speaker; in the Speaker's absence the Deputy Speaker, and then the Deputy Chairman of the Rajya Sabha. The President summons the joint sitting but does not preside; the Chairman of the Rajya Sabha has no role in presiding over it; seniority does not decide the chair.

Q3. A joint sitting of Parliament under Article 108 CANNOT be held on which of the following?
1. A Money Bill
2. A Constitution Amendment Bill
3. An ordinary bill rejected by the Rajya Sabha after the Lok Sabha passed it
Select the correct answer using the code given below.

  1. 1 only
  2. 1 and 2 only
  3. 2 and 3 only
  4. 1, 2 and 3
Show answer

Answer: B. 1 and 2 only

A Money Bill cannot be deadlocked because the Rajya Sabha cannot reject it, and a Constitution Amendment Bill must be passed by each House separately under Article 368. An ordinary bill rejected by the other House is exactly the case Article 108 covers, so any option containing 3 is wrong, and '1 only' leaves out the amendment bill.

Q4. The quorum to constitute a meeting of either House of Parliament is

  1. one-tenth of the total number of members of the House
  2. one-fourth of the members present
  3. one-third of the total number of members of the House
  4. a majority of the total number of members of the House

Answer: A. one-tenth of the total number of members of the House

Q8. Which of the following bills were passed at a joint sitting of Parliament?
1. The Dowry Prohibition Bill, 1961
2. The Prevention of Terrorism Bill, 2002
3. The Constitution (Forty-fourth Amendment) Bill, 1978
Select the correct answer using the code given below.

  1. 1 and 2 only
  2. 2 and 3 only
  3. 1 and 3 only
  4. 1, 2 and 3
Show answer

Answer: A. 1 and 2 only

The three joint sittings were on the Dowry Prohibition Bill (1961), the Banking Service Commission (Repeal) Bill (1978) and the Prevention of Terrorism Bill (2002). A Constitution Amendment Bill can never go to a joint sitting, so every option containing 3 is wrong.
