Law-making and the Budget
How an ordinary bill becomes law, the President's assent and the kinds of veto, Money Bills and financial bills, how the Budget is passed, and the three funds of the Union.

(→ English: vote on account · हिन्दी: लेखानुदान)
Exam traps
- The word 'budget' does not appear in the Constitution; Article 112 calls it the annual financial statement.
- A Money Bill must contain only the matters listed in Article 110(1). A bill that also contains other provisions is a financial bill under Article 117(1), which the Rajya Sabha can amend or reject.
- The Rajya Sabha can delay a Money Bill by at most 14 days and can only make recommendations; the Lok Sabha is free to ignore them.
- Salaries of High Court judges are charged on the Consolidated Fund of the State; only their pensions are charged on the Consolidated Fund of India.
- The Lok Sabha can assent to, reduce or refuse a demand for grants, but cannot increase it; the Rajya Sabha does not vote on demands.
- Policy cut: reduce the demand to one rupee. Token cut: reduce it by one hundred rupees. Economy cut: reduce it by a specified amount.
- The President cannot return a Money Bill and must assent to a Constitution Amendment Bill (24th Amendment, 1971). The pocket veto exists only because Article 111 sets no time limit.
- Payments from the Public Account need no appropriation by Parliament; the Contingency Fund is at the disposal of the President and is later recouped from the Consolidated Fund.
Recap
- Articles 265 and 266(3): no tax without law, no withdrawal from the Consolidated Fund without law.
- Ordinary bill: three readings in each House; clause-by-clause consideration at the second reading; deadlock goes to a joint sitting (Article 108).
- Article 111: assent, withhold (absolute veto) or return once (suspensive veto); no time limit, hence the pocket veto (1986).
- Money Bill (Articles 109–110): only the listed matters; Lok Sabha only, on the President's recommendation; Speaker's certificate final; Rajya Sabha 14 days, recommendations only.
- Financial bills (Article 117): 117(1) begins in the Lok Sabha on recommendation but is otherwise ordinary; 117(3) may begin in either House but needs a recommendation for consideration.
- Budget (Articles 112–114): charged expenditure discussed, not voted; demands voted only by the Lok Sabha; cut motions; guillotine; Appropriation Bill; Finance Bill within 75 days.
- Articles 115–116: supplementary, additional and excess grants; vote on account, vote of credit, exceptional grant.
- Funds: Consolidated Fund 266(1) (law needed), Public Account 266(2) (no appropriation), Contingency Fund 267 (President, Act of 1950).
Practice questions
Q1. Consider the following statements about a Money Bill:
1. It can be introduced only in the Lok Sabha.
2. The Rajya Sabha may return it with amendments within 14 days.
3. If a question arises whether a bill is a Money Bill, the decision of the Speaker of the Lok Sabha is final.
Which of the statements given above is/are correct?
- 1 only
- 1 and 3 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 3 only
Statements 1 and 3 follow Articles 109(1) and 110(3). Statement 2 is wrong: the Rajya Sabha can only make recommendations, not amendments, and the Lok Sabha may accept or reject them. So '1 only' leaves out a correct statement, and any option containing 2 is wrong.
Q2. Which one of the following is NOT charged on the Consolidated Fund of India?
- Salaries and allowances of judges of the Supreme Court
- Pensions of judges of High Courts
- Salaries and allowances of judges of High Courts
- Emoluments and allowances of the President
Show answer
Answer: C. Salaries and allowances of judges of High Courts
Article 112(3) charges the salaries of Supreme Court judges, the pensions of High Court judges and the President's emoluments on the Consolidated Fund of India. The salaries of High Court judges are charged on the Consolidated Fund of the State (Article 202(3)), so that is the one not charged on the Union's Fund.
Q3. The 'pocket veto' of the President of India is possible because
- Article 111 expressly gives the President this power
- the Constitution fixes no time limit within which the President must act on a bill
- the President may return a Money Bill for reconsideration
- a bill returned once may be returned again
Show answer
Answer: B. the Constitution fixes no time limit within which the President must act on a bill
Article 111 does not mention any veto by name and sets no time limit, so the President can simply keep a bill pending, as President Zail Singh did with the Indian Post Office (Amendment) Bill, 1986. A Money Bill cannot be returned, and a bill passed again after being returned must receive assent, so the other options are wrong.
Q4. Match List I (cut motion) with List II (what it proposes):
List I
A. Policy cut
B. Economy cut
C. Token cut
List II
1. Reduce the demand by one hundred rupees
2. Reduce the demand to one rupee
3. Reduce the demand by a specified amount
Select the correct answer using the code given below.
- A-2, B-3, C-1
- A-1, B-3, C-2
- A-2, B-1, C-3
- A-3, B-2, C-1
Show answer
Answer: A. A-2, B-3, C-1
A policy cut reduces the demand to one rupee to show disapproval of the policy; an economy cut reduces it by a specified amount; a token cut reduces it by one hundred rupees to air a specific grievance. The other codes swap the policy and token cuts or misplace the economy cut.
Q5. Consider the following statements about a bill that would involve expenditure from the Consolidated Fund of India but contains none of the matters listed in Article 110 (Article 117(3)):
1. It may be introduced in the Rajya Sabha.
2. It cannot be introduced without the recommendation of the President.
3. Neither House can pass it unless the President has recommended its consideration to that House.
Which of the statements given above is/are correct?
- 1 only
- 2 and 3 only
- 1 and 3 only
- 1, 2 and 3
Show answer
Answer: C. 1 and 3 only
An Article 117(3) bill may begin in either House and needs no recommendation for introduction, so statement 2 is wrong; the recommendation is needed only before a House considers and passes it, so statement 3 is correct. '1 only' misses statement 3, and options with statement 2 are wrong.
Q6. Which one of the following is credited to the Public Account of India rather than to the Consolidated Fund of India?
- Income tax collected by the Union
- Money raised by the issue of treasury bills
- Provident fund deposits
- Money received in repayment of loans given by the Union
Show answer
Answer: C. Provident fund deposits
Article 266(1) sends all revenues (such as income tax), all loans raised (such as treasury bills) and all repayments of loans to the Consolidated Fund. Other public money that the government holds, such as provident fund deposits, goes to the Public Account under Article 266(2).
Q7. A grant made by the Lok Sabha in advance for part of a financial year, pending the completion of the voting on the Budget, is called
- a vote of credit
- an exceptional grant
- a supplementary grant
- a vote on account
Show answer
Answer: D. a vote on account
Article 116(1)(a) provides for a vote on account. A vote of credit meets an unexpected demand that cannot be described in the usual detail; an exceptional grant is for a purpose outside the current service of any year; a supplementary grant (Article 115) tops up an insufficient grant during the year.
Q8. Consider the following statements about an ordinary bill:
1. A bill pending in the Rajya Sabha that has not been passed by the Lok Sabha lapses when the Lok Sabha is dissolved.
2. The bill is considered clause by clause at the second reading.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Article 107(4) says such a bill does not lapse on dissolution, so statement 1 is wrong. Clause-by-clause consideration and voting on amendments happen at the second reading, so statement 2 is correct. Options with statement 1 are wrong, and 'neither' ignores statement 2.
