Exam traps
- The 74th Amendment came into force on 1 June 1993; the 73rd on 24 April 1993. The Twelfth Schedule (municipalities) has 18 matters; the Eleventh (panchayats) has 29.
- A Nagar Panchayat is an urban body under Part IXA (an area in transition from rural to urban), not a village panchayat under Part IX.
- Ward committees are compulsory only in municipalities with a population of three lakh or more; a metropolitan area means ten lakh or more.
- In the District Planning Committee at least four-fifths of members are elected; in the Metropolitan Planning Committee at least two-thirds.
- Rajendra N. Shah (2021) struck down Part IXB only for co-operatives within a State; it still applies to multi-State co-operative societies.
- A Governor appointed administrator of a neighbouring Union Territory acts independently of his own State's council of ministers (Article 239(2)).
- Delhi's Assembly cannot legislate on public order, police or land, and its council of ministers is capped at ten per cent of the Assembly; for States the cap is fifteen per cent.
- Article 371A is Nagaland and 371G Mizoram (shield for customary law and land); 371J is Karnataka (98th Amendment, 2012), 371I Goa, 371H Arunachal Pradesh. Article 370 is a different provision, on Jammu and Kashmir.

Practice questions
Q1. The Twelfth Schedule of the Constitution, added by the 74th Amendment, contains how many matters for municipalities?
- 11
- 18
- 29
- 47
Show answer
Answer: B. 18
The Twelfth Schedule lists 18 matters. 29 is the count in the Eleventh Schedule for panchayats; 11 and 47 match no Schedule of local government.
Q2. Consider the following statements:
1. Under Article 243S, ward committees must be constituted in every municipality with a population of three lakh or more.
2. A metropolitan area under Article 243P is an area with a population of ten lakh or more.
3. At least two-thirds of the members of a District Planning Committee must be elected.
Which of the statements given above is/are correct?
- 1 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 2 only
Statements 1 and 2 are correct. Statement 3 is wrong: the District Planning Committee needs at least four-fifths elected members; two-thirds is the rule for the Metropolitan Planning Committee. '1 only' misses statement 2, and the options containing 3 are wrong.
Q3. Which one of the following is NOT one of the three types of municipality named in Article 243Q?
- Nagar Panchayat
- Municipal Council
- Municipal Corporation
- Cantonment Board
Show answer
Answer: D. Cantonment Board
Article 243Q names the Nagar Panchayat, the Municipal Council and the Municipal Corporation. A Cantonment Board is not among them, so it is the answer; the other three options are the types the Article provides.
Q4. In Union of India v. Rajendra N. Shah (2021), the Supreme Court held that Part IXB of the Constitution:
- is wholly valid, because co-operatives are a Union subject
- is invalid for co-operatives within a State but survives for multi-State co-operative societies
- is wholly invalid, including for multi-State co-operative societies
- applies only to urban co-operative banks

Answer: B. is invalid for co-operatives within a State but survives for multi-State co-operative societies
The Court struck down Part IXB for co-operatives within a State, because the 97th Amendment touched a State List subject without ratification by half the States, but kept it for multi-State societies. Co-operatives are a State subject, so the first option is wrong; the Part was not wholly struck down; and the case was not limited to urban co-operative banks.
Q5. Consider the following statements about Union Territories:
1. Every Union Territory is administered by the President acting through an administrator.
2. A Governor appointed as administrator of an adjoining Union Territory acts on the advice of his own State's council of ministers in that role.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is Article 239(1). Statement 2 is wrong: under Article 239(2) such a Governor acts independently of his council of ministers. So '2 only' and 'Both' are wrong, and 'Neither' ignores the correct statement 1.
Q6. Which of the following subjects is/are outside the legislative power of the Legislative Assembly of the National Capital Territory of Delhi?
1. Public order
2. Police
3. Land
4. Public health
Select the correct answer using the code given below.
- 1 and 2 only
- 1, 2 and 3 only
- 2, 3 and 4 only
- 1, 2, 3 and 4
Show answer
Answer: B. 1, 2 and 3 only
Article 239AA keeps public order, police and land with the Union. Public health is a State List matter on which the Delhi Assembly can legislate, so options containing 4 are wrong, and '1 and 2 only' leaves out land.

Show answer
Answer: A. A-3, B-4, C-1, D-2
371A is Nagaland, 371G Mizoram, 371I Goa and 371J Karnataka. The second option swaps Nagaland and Mizoram, the third swaps Goa and Karnataka, and the fourth matches none correctly.
Q8. Consider the following statements:
1. Article 240 allows the President to make regulations for Lakshadweep that may amend an Act of Parliament as it applies there.
2. Parliament cannot make laws for a Union Territory on matters in the State List.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2

Show answer
Answer: A. 1 only
Statement 1 is correct under Article 240. Statement 2 is wrong: Article 246(4) lets Parliament legislate for areas outside States on any matter, including State List matters. So '2 only' and 'Both' are wrong, and 'Neither' ignores statement 1.
