Panchayati Raj
How panchayats grew from Article 40 and the Balwant Rai Mehta, Ashok Mehta, G.V.K. Rao and L.M. Singhvi committees to the 73rd Amendment; Part IX article by article (Gram Sabha, three tiers, reservation, elections and the State Election Commission, powers, finance and the State Finance Commission); the areas left out by Article 243M; and PESA, 1996.
(→ English: Panchayati Raj, Directive Principles of State Policy · हिन्दी: पंचायती राज, राज्य की नीति के निदेशक तत्व)
| Committee (year) | Main recommendation |
|---|---|
| Balwant Rai Mehta (1957) | Three tiers (village, block, district); 'democratic decentralisation' |
| Ashok Mehta (report 1978) | Two tiers: district and mandal panchayat |
| G.V.K. Rao (1985) | District as the main unit of planning and development |
| L.M. Singhvi (1986) | Constitutional status for panchayats |
| Compulsory for every State | Left to the State |
|---|---|
| Gram Sabha in each village (Article 243A) | Powers of the Gram Sabha |
| Three tiers; intermediate tier optional below 20 lakh population (Article 243B) | How the village panchayat chairperson is elected |
| Direct election to all seats (Article 243C) | Seats for MPs and MLAs in the higher tiers |
| Reservation for SCs, STs and at least one-third for women (Article 243D) | Reservation for backward classes |
| Five-year term; election within six months of dissolution (Article 243E) | Which Eleventh Schedule matters to devolve (Article 243G) |
| State Election Commission and State Finance Commission (Articles 243K, 243I) | Taxes and grants for panchayats (Article 243H) |
Exam traps
- Article 40 (a Directive Principle) asked for village panchayats from 1950, but constitutional status came only with the 73rd Amendment (1992, in force 24 April 1993); the 64th Amendment Bill of 1989 failed in the Rajya Sabha.
- Balwant Rai Mehta (1957) recommended three tiers; Ashok Mehta (1978) recommended two. Rajasthan (Nagaur, 2 October 1959) was the first State to start, not Andhra Pradesh.
- The intermediate tier may be skipped only in a State whose population does not exceed 20 lakh; the village and district tiers are always required.
- Chairpersons of intermediate and district panchayats must be elected indirectly by the elected members; for the village panchayat the method is left to State law.
- Women's reservation is 'not less than one-third' and includes seats reserved for SCs and STs; reservation for backward classes is optional for the State.
- Panchayat elections are conducted by the State Election Commission, not the Election Commission of India; the State Election Commissioner is appointed by the Governor but removed only like a High Court judge.
- The minimum age for panchayat membership is 21, not 25.
- PESA (1996) covers Fifth Schedule areas in ten States, not Sixth Schedule areas; it reserves at least half the seats and all chairpersons' posts for Scheduled Tribes.
Recap
- Article 40 asked for village panchayats; the 73rd Amendment (1992, in force 24 April 1993) gave them constitutional status through Part IX (Articles 243–243O) and the Eleventh Schedule (29 matters).
- Path: Community Development Programme (1952), Balwant Rai Mehta (1957, three tiers), Rajasthan first (Nagaur, 1959), Ashok Mehta (1978, two tiers), G.V.K. Rao (1985), L.M. Singhvi (1986), failed 64th Amendment Bill (1989).
- Gram Sabha = all voters of the village (Article 243A); powers given by State law.
- Three tiers (Article 243B), intermediate tier optional below 20 lakh population; all seats directly elected; intermediate and district chairpersons elected indirectly (Article 243C).
- Reservation (Article 243D): SCs and STs by population, at least one-third for women, chairpersons too; backward classes optional; Krishna Murthy (2010) and the triple test (2021).
- Five-year term, elections within six months of dissolution, minimum age 21 (Articles 243E, 243F); State Election Commission removable only like a High Court judge (Article 243K); courts barred mid-election (Article 243O).
- Powers and money enabled by State law (Articles 243G, 243H); State Finance Commission every five years (Article 243I); audit by State law (Article 243J).
- Excluded areas (Article 243M); PESA 1996 extends Part IX to Fifth Schedule areas of ten States with strong Gram Sabha powers and ST reservation.
Practice questions
Q1. The Panchayati Raj system on the Balwant Rai Mehta pattern was first launched in which district?
- Nagaur, Rajasthan
- Anantapur, Andhra Pradesh
- Pune, Maharashtra
- Kheda, Gujarat
Show answer
Answer: A. Nagaur, Rajasthan
Rajasthan launched the system in Nagaur district on 2 October 1959. Andhra Pradesh followed Rajasthan, so it was not first; Maharashtra and Gujarat adopted the system later and were not the starting point.
Q2. Consider the following statements:
1. The Balwant Rai Mehta Committee recommended a three-tier system of panchayats.
2. The Ashok Mehta Committee recommended a two-tier system.
3. The 64th Constitution Amendment Bill on panchayats was passed by both Houses of Parliament in 1989.
Which of the statements given above is/are correct?
- 1 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 2 only
Statements 1 and 2 are correct. Statement 3 is wrong: the 64th Amendment Bill failed in the Rajya Sabha, and constitutional status came only with the 73rd Amendment in 1992. '1 only' leaves out the correct statement 2, and the options containing 3 are wrong.
Q3. What is the minimum age for a person to be chosen as a member of a panchayat under Article 243F?
- 18 years
- 21 years
- 25 years
- 30 years
Show answer
Answer: B. 21 years
Article 243F says a person shall not be disqualified on the ground of being under 25 if he has attained 21, so the minimum is 21. Eighteen is the voting age, not the age to be a member; 25 is the minimum for the Legislative Assembly; 30 is for the Legislative Council and the Rajya Sabha.
Q4. Consider the following statements about the State Election Commission:
1. The State Election Commissioner is appointed by the Governor.
2. The State Election Commissioner holds office during the pleasure of the Governor.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 follows Article 243K(1). Statement 2 is wrong: Article 243K(2) says the Commissioner can be removed only in the manner and on the grounds that apply to a High Court judge, so there is no tenure at the Governor's pleasure. Hence '2 only' and 'both' are wrong, and 'neither' ignores the correct statement 1.
Q5. Under Article 243B, panchayats at the intermediate level need not be constituted in a State whose population does not exceed:
- 10 lakh
- 20 lakh
- 25 lakh
- 50 lakh
Show answer
Answer: B. 20 lakh
Article 243B(2) sets the threshold at twenty lakh. The figures of 10, 25 and 50 lakh do not appear in Part IX.
Q6. Match List I (Article) with List II (subject):
List I
A. Article 243A
B. Article 243D
C. Article 243I
D. Article 243K
List II
1. State Finance Commission
2. Gram Sabha
3. State Election Commission
4. Reservation of seats
Select the correct answer using the code given below:
- A-2, B-4, C-1, D-3
- A-2, B-4, C-3, D-1
- A-4, B-2, C-1, D-3
- A-1, B-3, C-2, D-4
Show answer
Answer: A. A-2, B-4, C-1, D-3
Article 243A is the Gram Sabha, 243D reservation, 243I the State Finance Commission and 243K the State Election Commission. The second code swaps the two commissions; the third swaps the Gram Sabha and reservation; the fourth matches none correctly.
Q7. Consider the following statements about the Panchayats (Extension to the Scheduled Areas) Act, 1996:
1. It applies to the tribal areas of the Sixth Schedule.
2. At least one-half of the seats in panchayats at every level are reserved for Scheduled Tribes.
3. It gives the Gram Sabha ownership of minor forest produce.
Which of the statements given above is/are correct?
- 1 and 2 only
- 2 and 3 only
- 3 only
- 1, 2 and 3
Show answer
Answer: B. 2 and 3 only
Statements 2 and 3 are correct. Statement 1 is wrong: PESA extends Part IX to the Fifth Schedule (Scheduled) Areas of ten States; Sixth Schedule areas have autonomous district councils instead. '3 only' leaves out the correct statement 2, and the options with 1 are wrong.
Q8. Under Article 243M, Part IX of the Constitution does NOT apply to which one of the following States?
- Tripura
- Nagaland
- Sikkim
- Assam
Show answer
Answer: B. Nagaland
Article 243M(2) excludes the States of Nagaland, Meghalaya and Mizoram as a whole. Tripura and Assam are not excluded as States; only their Sixth Schedule tribal areas fall outside Part IX. Sikkim is not mentioned in Article 243M, so Part IX applies there.
