Electoral system, the Representation of the People Acts, delimitation and reforms
How India's elections are organised: the principles of Part XV, first-past-the-post and proportional representation, the Representation of the People Acts of 1950 and 1951, delimitation and reserved seats, disqualification and corrupt practices, election petitions, and reforms from EVMs and NOTA to candidate disclosure and the end of electoral bonds.
| Office or House | Electors | Method |
|---|---|---|
| Lok Sabha | Voters registered in each constituency | First-past-the-post, single-member seats |
| State Legislative Assembly | Voters registered in each constituency | First-past-the-post, single-member seats |
| Rajya Sabha | Elected members of each State Assembly (and of the UT legislatures that elect members) | Proportional representation by single transferable vote |
| President | Elected members of both Houses of Parliament and of the State Assemblies, including Delhi and Puducherry | Proportional representation by single transferable vote, secret ballot |
| Vice-President | All members of both Houses of Parliament, elected and nominated | Proportional representation by single transferable vote, secret ballot |
(→ English: Model Code of Conduct · हिन्दी: आदर्श आचार संहिता)
Exam traps
- Article 325 forbids exclusion from the roll on grounds only of religion, race, caste or sex; it does not mention place of birth or language.
- Reserved SC and ST seats use a joint electorate: only the candidate must belong to the group, not the voters.
- Rajya Sabha members are elected by elected MLAs only; nominated MLAs and Legislative Council members have no vote.
- Delimitation orders cannot be challenged in any court (Article 329); the freeze on seats per State runs until the first census after 2026 (84th Amendment), but boundaries were redrawn on the 2001 census.
- Election disputes go to the High Court by election petition, not to the Election Commission; the appeal lies to the Supreme Court.
- Disqualification on conviction needs a sentence of at least two years and lasts for six years after release; Lily Thomas (2013) ended the protection for sitting members under section 8(4).
- NOTA (PUCL, 2013) records rejection but cannot defeat the leading candidate; VVPAT came from Subramanian Swamy (2013).
- The Model Code of Conduct is not a statute; it starts when the schedule is announced, not when notification is issued.
Recap
- Part XV (Articles 324–329): Commission's control, one roll, adult franchise, laws by Parliament, courts kept out.
- First-past-the-post for the Lok Sabha and Assemblies; single transferable vote for the Rajya Sabha, President and Vice-President.
- RPA 1950: seats, rolls, Electoral Registration Officers; citizen, 18, ordinarily resident; four qualifying dates since 2021.
- Delimitation Commissions 1952, 1963, 1973, 2002; seats per State frozen on the 1971 census until after 2026.
- SC/ST reservation with a joint electorate, extended to 2030; one-third for women after the next delimitation (106th Amendment).
- RPA 1951: two-year sentence disqualifies; Lily Thomas (2013); at most two constituencies; deposit lost below one-sixth.
- Corrupt practices (section 123); election petitions to the High Court within 45 days; party registration under section 29A.
- Reforms: EPIC (1993), EVMs (section 61A), VVPAT, NOTA, candidate affidavits (2002), electoral bonds struck down (2024), Model Code of Conduct.
Practice questions
Q1. Under Article 325 of the Constitution of India, no person shall be ineligible for inclusion in an electoral roll on grounds only of
- religion, race, caste or sex
- religion, caste, language or place of birth
- race, sex, descent or residence
- caste, sex, property or education
Show answer
Answer: A. religion, race, caste or sex
Article 325 names religion, race, caste and sex. Language and place of birth are not in it, residence is actually a condition for registration, and property and education do not appear in the Article at all.
Q2. Consider the following statements:
1. A State's seats in the Rajya Sabha are filled through voting by the elected MLAs of that State, using the single transferable vote form of proportional representation.
2. The Vice-President is elected only by the elected members of both Houses of Parliament.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct. Statement 2 is wrong: the Vice-President's electoral college includes all members of both Houses, nominated members too. So '2 only' and 'both' are wrong, and 'neither' ignores statement 1.
Q3. With reference to delimitation in India, consider the following statements:
1. Orders of the Delimitation Commission can be challenged in the High Court.
2. How many Lok Sabha seats each State gets stays locked to the 1971 census figures, and will stay so until the first census held after 2026.
3. Constituency boundaries within States were redrawn on the basis of the 2001 census.
Which of the statements given above are correct?
- 1 and 2 only
- 2 and 3 only
- 1 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 2 and 3 only
Statements 2 and 3 are correct. Statement 1 is wrong: delimitation orders have the force of law and Article 329 bars any court from questioning them. Every option that includes statement 1 is therefore wrong.
Q4. Match List I with List II:
List I (Case)
A. Lily Thomas v. Union of India (2013)
B. PUCL v. Union of India (2013)
C. Union of India v. ADR (2002)
D. ADR v. Union of India (2024)
List II (Outcome)
1. Candidates must disclose criminal record, assets and education
2. Electoral bond scheme struck down
3. 'None of the Above' option on the ballot
4. Protection for sitting legislators under section 8(4) struck down
Select the correct answer using the code given below:
- A-4, B-3, C-1, D-2
- A-3, B-4, C-1, D-2
- A-4, B-3, C-2, D-1
- A-1, B-3, C-4, D-2
Show answer
Answer: A. A-4, B-3, C-1, D-2
Lily Thomas struck down section 8(4) (4), PUCL gave NOTA (3), the 2002 ADR case required disclosure (1) and the 2024 ADR case ended electoral bonds (2). The second code swaps Lily Thomas and PUCL, the third swaps the two ADR cases, and the fourth swaps Lily Thomas and the 2002 case.
Q5. A dispute about the election of a member of the Lok Sabha is decided, in the first instance, by
- the Election Commission of India
- the Speaker of the Lok Sabha
- the High Court, on an election petition
- the President, on the advice of the Election Commission
Show answer
Answer: C. the High Court, on an election petition
Under the 1951 Act, election petitions are tried by the High Court, with an appeal to the Supreme Court. The Commission conducts elections but does not decide election disputes, the Speaker has no such role, and the President's decision on the Commission's opinion applies to questions of disqualification of sitting members under Article 103, not to disputes about the election itself.
Q6. Consider the following statements about seats reserved for Scheduled Castes in the Lok Sabha:
1. Only voters belonging to the Scheduled Castes can vote in a reserved constituency.
2. The reservation has been extended up to 2030 by the 104th Amendment.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: reserved seats use a joint electorate, so every registered voter in the constituency votes and only the candidate must be from the group. Statement 2 is correct. So '1 only' and 'both' are wrong, and 'neither' ignores statement 2.
Q7. Under the Representation of the People Act, 1951, a person convicted of an offence is disqualified from being a member of Parliament if sentenced to imprisonment for at least
- six months
- one year
- two years
- five years
Show answer
Answer: C. two years
Section 8(3) disqualifies a person sentenced to two years or more, from the date of conviction and for six years after release. Six months and one year are below the threshold, and five years confuses the threshold with a longer term.
Q8. Consider the following statements about the Model Code of Conduct:
1. It is contained in the Representation of the People Act, 1951.
2. It comes into force from the announcement of the election schedule by the Election Commission.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: the Code is a set of guidelines evolved with political parties, not part of any Act. Statement 2 is correct. So '1 only' and 'both' are wrong, and 'neither' ignores statement 2.
