Elections · Part 1 / 1 · Fact-checked on · how we check

Written with AI from the sources listed at the bottom of this page, then fact-checked by a separate AI.

How India's elections are organised: the principles of Part XV, first-past-the-post and proportional representation, the Representation of the People Acts of 1950 and 1951, delimitation and reserved seats, disqualification and corrupt practices, election petitions, and reforms from EVMs and NOTA to candidate disclosure and the end of electoral bonds.

Each idea is explained first in Tamil (தமிழ்), ending with the English and Hindi exam terms, followed by the same point in exam English. UPSC Prelims is in English or Hindi, so understand it in Tamil and revise it in English.

In exam EnglishIndia's general elections are the largest exercise of their kind in the world, and the rules behind them come in three layers. At the top is Part XV of the Constitution, Articles 324 to 329, which states the basic principles and places elections under the Election Commission. Below it are two Acts of Parliament: the Representation of the People Act, 1950, which deals with seats, constituencies and voter lists, and the Representation of the People Act, 1951, which deals with who may stand, how polls are conducted and how disputes are settled. Around both sit the Commission's own instructions and the Model Code of Conduct. The Commission's composition is covered in the chapter on constitutional bodies; this chapter explains the system it runs and the reforms made to it.

In exam EnglishPart XV is short but carries the core principles. Article 324 vests the superintendence, direction and control of elections to Parliament, the State legislatures and the offices of President and Vice-President in the Election Commission. Article 325 provides one general electoral roll for every territorial constituency and forbids leaving anyone out of it, or making a separate roll, on the ground only of religion, race, caste or sex; this ended the separate electorates of the colonial period. Article 326 bases elections to the Lok Sabha and the State Assemblies on universal adult franchise. Articles 327 and 328 let Parliament, and subject to it the State legislatures, make laws on elections. Article 329 keeps courts out of the process: laws on delimitation cannot be questioned in any court, and an election can be challenged only by an election petition.

In exam EnglishIndia uses two voting systems. For the Lok Sabha and the State Legislative Assemblies it uses single-member constituencies and the first-past-the-post rule: the candidate with the most votes wins, even without a majority of the votes cast. The method is simple for voters and tends to produce clear results, but a party's share of seats can differ sharply from its share of votes. For indirect elections the Constitution uses proportional representation by means of the single transferable vote, in which each elector ranks the candidates in order of preference and surplus or eliminated votes pass to the next choice. Members of the Rajya Sabha are chosen this way by the elected members of the State Assemblies, and the President and Vice-President are elected by the same method, each by a different electoral college, as the table shows.

In exam EnglishThe Representation of the People Act, 1950 provides the machinery that must be ready before polling day. It allocates seats in the Lok Sabha and the Assemblies among the States and gives effect to delimitation orders. It provides for a Chief Electoral Officer in each State and an Electoral Registration Officer for each constituency, who prepares and revises the electoral roll. A person is entitled to be registered in the constituency where he is ordinarily resident if he is a citizen and has reached eighteen years on the qualifying date, and nobody may be registered in more than one constituency. Since a 2021 amendment there are four qualifying dates in a year, 1 January, 1 April, 1 July and 1 October. Suppose a student turns eighteen in May: she can apply to be enrolled against the 1 July date instead of waiting until the next January.

In exam Englishdelimitation means fixing the number of seats for each State and drawing constituency boundaries so that each seat has roughly the same population. Articles 82 and 170 require the seats to be readjusted after every census, and Parliament has given the task to Delimitation Commissions set up under Delimitation Acts; such commissions were constituted in 1952, 1963, 1973 and 2002. Their orders have the force of law and, because of Article 329, cannot be questioned in any court. To avoid penalising States that had controlled their population growth, the 42nd Amendment (1976) froze the number of seats for each State on the basis of the 1971 census, and the 84th Amendment (2001) extended the freeze until the first census taken after 2026. Boundaries within each State were still redrawn on the 2001 census, as the 87th Amendment (2003) allowed, without changing any State's total.

In exam EnglishDelimitation also decides which constituencies are reserved. Articles 330 and 332 reserve seats for Scheduled Castes and Scheduled Tribes in the Lok Sabha and the State Assemblies, broadly in proportion to their share of the population. Only a member of the group can contest a reserved seat, but every voter in the constituency votes; this joint electorate is quite different from the separate electorates that Article 325 rules out. The reservation was originally meant to last ten years and has been extended several times; the 104th Amendment (2019) extended it to 2030 while ending the nomination of Anglo-Indian members. The 106th Amendment (2023) provides for reserving one-third of the seats for women in the Lok Sabha, the State Assemblies and the Delhi Assembly, to take effect after the first delimitation based on a census held after its commencement, and to last fifteen years.

In exam EnglishThe Representation of the People Act, 1951 decides who may stand and who may not. To contest a Lok Sabha seat a person must be an elector in a parliamentary constituency, and for a reserved seat must belong to the group for which it is reserved; the Constitution adds the minimum ages of 25 for the Lok Sabha and the Assemblies and 30 for the Rajya Sabha. Section 8 sets out disqualification for crimes: a person convicted and sentenced to imprisonment for two years or more is disqualified from the date of conviction and for a further six years after release. Section 8(4) once protected sitting members who appealed within three months, but the Supreme Court struck it down in Lily Thomas v. Union of India (2013). A candidate may contest from at most two constituencies, and forfeits the security deposit if he fails to win more than one-sixth of the valid votes polled.

In exam EnglishThe same Act governs the conduct of elections and the settling of disputes. Section 123 defines corrupt practices, among them bribery, undue influence, appeals to vote or not to vote on the ground of religion, race, caste, community or language, and spending beyond the prescribed limit; a candidate found guilty can lose the seat and be disqualified. Disputes go not to the Election Commission but to the High Court, through an election petition filed within forty-five days of the declaration of the result, with an appeal to the Supreme Court. Section 29A, inserted in 1989, provides for the registration of political parties with the Commission. Recognition as a national or State party, and the reserved symbol that comes with it, depends on votes and seats won under the Commission's Election Symbols (Reservation and Allotment) Order, 1968.

In exam EnglishMany reforms have aimed at clean and easy polling. Electors' Photo Identity Cards were introduced in 1993 to curb impersonation. Electronic voting machines were first tried in 1982 at Paravur in Kerala; after the Supreme Court held in 1984 that their use lacked a basis in law, Parliament inserted section 61A into the 1951 Act in 1988, and EVMs were used in every constituency from the 2004 general election. In Subramanian Swamy v. Election Commission of India (2013) the Court held that a paper trail was needed for voters' confidence, which led to the Voter Verifiable Paper Audit Trail, a slip the voter can see behind glass for a few seconds. In People's Union for Civil Liberties v. Union of India (2013) it directed a 'None of the Above' option, letting a voter reject every candidate in secret; NOTA votes are counted but cannot change who wins.

(→ English: Model Code of Conduct · हिन्दी: आदर्श आचार संहिता)

In exam EnglishOther reforms target money and crime. In Union of India v. Association for Democratic Reforms (2002) the Supreme Court held that voters have a right to know about those who seek their vote, and candidates must now declare their criminal record, assets and liabilities, and educational qualifications in an affidavit with their nomination. In Association for Democratic Reforms v. Union of India (February 2024) a five-judge bench struck down the electoral bond scheme, which allowed anonymous donations to political parties, because it violated voters' right to information under Article 19(1)(a). The Model Code of Conduct is a set of guidelines evolved with the agreement of political parties rather than a law. It applies from the announcement of the election schedule and, for instance, stops ministers from announcing new schemes or grants once polls are called; the Commission enforces it through notices and censure under its powers in Article 324.

In exam EnglishTaken together, the system works at three levels. The Constitution guarantees one roll, adult franchise and a Commission beyond the government's control, and keeps the courts out until the result is declared. The 1950 Act prepares the ground: seats, constituencies and rolls. The 1951 Act governs the contest itself: candidates, conduct, corrupt practices and election petitions. Delimitation links population to representation, which is why the freeze until after 2026 matters so much for the balance between States. Reforms, many of them pushed by the Supreme Court, have added identity cards, EVMs with a paper trail, NOTA, disclosure of candidates' records and limits on anonymous money. The next chapter, on amendment and the basic structure, shows how free and fair elections came to be counted among the Constitution's essential features.

Recap

Practice questions

Q1. Under Article 325 of the Constitution of India, no person shall be ineligible for inclusion in an electoral roll on grounds only of

  1. religion, race, caste or sex
  2. religion, caste, language or place of birth
  3. race, sex, descent or residence
  4. caste, sex, property or education
Show answer

Answer: A. religion, race, caste or sex

Article 325 names religion, race, caste and sex. Language and place of birth are not in it, residence is actually a condition for registration, and property and education do not appear in the Article at all.

Q2. Consider the following statements:
1. A State's seats in the Rajya Sabha are filled through voting by the elected MLAs of that State, using the single transferable vote form of proportional representation.
2. The Vice-President is elected only by the elected members of both Houses of Parliament.
Which of the statements given above is/are correct?

  1. 1 only
  2. 2 only
  3. Both 1 and 2
  4. Neither 1 nor 2
Show answer

Answer: A. 1 only

Statement 1 is correct. Statement 2 is wrong: the Vice-President's electoral college includes all members of both Houses, nominated members too. So '2 only' and 'both' are wrong, and 'neither' ignores statement 1.

Q3. With reference to delimitation in India, consider the following statements:
1. Orders of the Delimitation Commission can be challenged in the High Court.
2. How many Lok Sabha seats each State gets stays locked to the 1971 census figures, and will stay so until the first census held after 2026.
3. Constituency boundaries within States were redrawn on the basis of the 2001 census.
Which of the statements given above are correct?

  1. 1 and 2 only
  2. 2 and 3 only
  3. 1 and 3 only
  4. 1, 2 and 3
Show answer

Answer: B. 2 and 3 only

Statements 2 and 3 are correct. Statement 1 is wrong: delimitation orders have the force of law and Article 329 bars any court from questioning them. Every option that includes statement 1 is therefore wrong.

Q4. Match List I with List II:
List I (Case)
A. Lily Thomas v. Union of India (2013)
B. PUCL v. Union of India (2013)
C. Union of India v. ADR (2002)
D. ADR v. Union of India (2024)
List II (Outcome)
1. Candidates must disclose criminal record, assets and education
2. Electoral bond scheme struck down
3. 'None of the Above' option on the ballot
4. Protection for sitting legislators under section 8(4) struck down
Select the correct answer using the code given below:

  1. A-4, B-3, C-1, D-2
  2. A-3, B-4, C-1, D-2
  3. A-4, B-3, C-2, D-1
  4. A-1, B-3, C-4, D-2
Show answer

Answer: A. A-4, B-3, C-1, D-2

Lily Thomas struck down section 8(4) (4), PUCL gave NOTA (3), the 2002 ADR case required disclosure (1) and the 2024 ADR case ended electoral bonds (2). The second code swaps Lily Thomas and PUCL, the third swaps the two ADR cases, and the fourth swaps Lily Thomas and the 2002 case.

Q5. A dispute about the election of a member of the Lok Sabha is decided, in the first instance, by

  1. the Election Commission of India
  2. the Speaker of the Lok Sabha
  3. the High Court, on an election petition
  4. the President, on the advice of the Election Commission

Answer: C. the High Court, on an election petition

Under the 1951 Act, election petitions are tried by the High Court, with an appeal to the Supreme Court. The Commission conducts elections but does not decide election disputes, the Speaker has no such role, and the President's decision on the Commission's opinion applies to questions of disqualification of sitting members under Article 103, not to disputes about the election itself.

Q6. Consider the following statements about seats reserved for Scheduled Castes in the Lok Sabha:

2. The reservation has been extended up to 2030 by the 104th Amendment.
Which of the statements given above is/are correct?

  1. 1 only
  2. 2 only
  3. Both 1 and 2
  4. Neither 1 nor 2
Show answer

Answer: B. 2 only

Statement 1 is wrong: reserved seats use a joint electorate, so every registered voter in the constituency votes and only the candidate must be from the group. Statement 2 is correct. So '1 only' and 'both' are wrong, and 'neither' ignores statement 2.

Q7. Under the Representation of the People Act, 1951, a person convicted of an offence is disqualified from being a member of Parliament if sentenced to imprisonment for at least

  1. six months
  2. one year
  3. two years
  4. five years
Show answer

Answer: C. two years

Section 8(3) disqualifies a person sentenced to two years or more, from the date of conviction and for six years after release. Six months and one year are below the threshold, and five years confuses the threshold with a longer term.

Q8. Consider the following statements about the Model Code of Conduct:

  1. 1 only
  2. 2 only
  3. Both 1 and 2
  4. Neither 1 nor 2
Show answer

Statement 1 is wrong: the Code is a set of guidelines evolved with political parties, not part of any Act. Statement 2 is correct. So '1 only' and 'both' are wrong, and 'neither' ignores statement 2.
