Enforcement, Emergencies and Amendments (Articles 31–35 and beyond)
How Fundamental Rights are enforced (Articles 32 and 226, the five writs, public interest litigation), when they can be limited (Articles 33–35 and 359), how far Parliament can amend them, what happened to the right to property, and how they relate to the Directive Principles.
| Writ | Meaning | Purpose | Not available against |
|---|---|---|---|
| Habeas corpus | To have the body | Free a person detained without legal basis | Lawful detention by a competent court; available against private persons too |
| Mandamus | We command | Make a public authority perform its public duty | Private persons or bodies; the President; Governors |
| Prohibition | To forbid | Stop a lower court or tribunal from exceeding its jurisdiction (before it decides) | Legislatures, private persons |
| Certiorari | To be certified | Quash an order already passed without jurisdiction or with an error of law | Legislatures, private persons |
| Quo warranto | By what authority | Test a person's legal right to hold a public office | Private offices, ministerial offices |
| Article 358 | Article 359 | |
|---|---|---|
| Rights affected | Article 19 only | Rights named in the President's order (never Articles 20 and 21) |
| How it works | Automatic once the emergency is proclaimed | Needs a separate Presidential order |
| Ground of emergency | War or external aggression only | Any ground of national emergency |
| What is suspended | The right itself | Only enforcement in court |
(→ English: Directive Principles of State Policy · हिन्दी: राज्य की नीति के निदेशक तत्व)
Exam traps
- Article 32 is itself a Fundamental Right; Article 226 is not, but its scope is wider ('for any other purpose').
- Habeas corpus can be issued against private persons; mandamus cannot.
- Prohibition is issued before a lower court decides; certiorari after. Neither lies against a legislature.
- Quo warranto can be sought by any interested person, not only the aggrieved person, and only for a public office created by law.
- Only Parliament, not state legislatures, can restrict the Fundamental Rights of the armed forces (Article 33).
- Under Article 359 the President suspends enforcement, not the rights themselves; Articles 20 and 21 can never be suspended (44th Amendment).
- Kesavananda Bharati (1973): Parliament can amend any part, including Fundamental Rights, but not the basic structure.
- Property is a legal right under Article 300A (44th Amendment, 1978); it cannot be enforced through Article 32. Ninth Schedule laws added after 24 April 1973 can be reviewed (I.R. Coelho, 2007).
Recap
- Article 32: right to move the Supreme Court is a Fundamental Right; 'soul and heart' (Ambedkar); part of the basic structure.
- Article 226: High Courts issue writs for Fundamental Rights and any other purpose; wider scope, not itself a Fundamental Right.
- Five writs: habeas corpus, mandamus, prohibition, certiorari, quo warranto.
- PIL: relaxed standing (S.P. Gupta 1981); letters can be treated as petitions; must be bona fide.
- Articles 33–35: Parliament alone can restrict rights of armed forces, police and intelligence; martial law; laws on offences in Part III.
- Article 359: President suspends enforcement of named rights in an emergency; never Articles 20 and 21; ADM Jabalpur (1976) overruled in Puttaswamy (2017).
- Amendment: Shankari Prasad (1951) → Golaknath (1967) → 24th Amendment (1971) → Kesavananda (1973, basic structure) → Minerva Mills (1980).
- Property: Articles 31A, 31B (Ninth Schedule), 31C; removed from Part III by the 44th Amendment; now Article 300A. FR are justiciable; DPSP are not (Article 37).
Practice questions
Q1. Consider the following statements:
1. The right to move the Supreme Court under Article 32 is itself a Fundamental Right.
2. The writ jurisdiction of the High Courts under Article 226 is narrower in scope than that of the Supreme Court under Article 32.
3. Parliament may by law empower any other court to issue writs within its local limits.
Which of the statements given above are correct?
- 1 and 2 only
- 1 and 3 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 3 only
Statements 1 and 3 are correct (Article 32(1) and 32(3)). Statement 2 is wrong: Article 226 is wider in scope, because High Courts can issue writs 'for any other purpose' as well as for Fundamental Rights.
Q2. Consider the following pairs of writs and their purposes:
1. Habeas corpus — to produce a detained person before the court
2. Mandamus — to command a public authority to perform its public duty
3. Certiorari — to stop a lower court from proceeding beyond its jurisdiction before it gives a decision
Which of the pairs given above is/are correctly matched?
- 1 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 2 only
Pairs 1 and 2 are correct. Pair 3 describes prohibition, which is issued before a decision; certiorari quashes an order already passed.
Q3. Which one of the following writs can be issued against a private individual?
- Habeas corpus
- Mandamus
- Certiorari
- Prohibition
Show answer
Answer: A. Habeas corpus
Habeas corpus lies against anyone who detains a person unlawfully, including private individuals. Mandamus lies only against public authorities, and certiorari and prohibition against courts, tribunals and certain authorities, not private persons.
Q4. With reference to the writ of quo warranto, consider the following statements:
1. It can be issued only in respect of a substantive public office created by a statute or the Constitution.
2. Only the person whose right has been directly affected can seek it.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct. Statement 2 is wrong: unlike most writs, quo warranto can be sought by any interested person, not only the aggrieved one.
Q5. During a national emergency, the enforcement of which of the following Fundamental Rights cannot be suspended under Article 359?
- Articles 14 and 19
- Articles 19 and 21
- Articles 20 and 21
- Articles 21 and 32
Show answer
Answer: C. Articles 20 and 21
Since the 44th Amendment (1978), Articles 20 and 21 cannot be suspended under Article 359. Article 19 is suspended automatically under Article 358 in a war or external-aggression emergency, and the enforcement of Articles 14 and 32 can be suspended by Presidential order.
Q6. Arrange the following Supreme Court judgments in chronological order:
1. Kesavananda Bharati v. State of Kerala
2. I.C. Golaknath v. State of Punjab
3. Minerva Mills v. Union of India
4. Shankari Prasad v. Union of India
Select the correct answer using the code below.
- 4-2-1-3
- 2-4-1-3
- 4-1-2-3
- 2-4-3-1
Show answer
Answer: A. 4-2-1-3
Shankari Prasad (1951), Golaknath (1967), Kesavananda Bharati (1973), Minerva Mills (1980).
Q7. Consider the following statements about the right to property today:
1. It is a constitutional and legal right under Article 300A.
2. A person deprived of property can directly approach the Supreme Court under Article 32.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct. Statement 2 is wrong: since the 44th Amendment (1978), property is not a Fundamental Right, so Article 32 is not available; the remedy lies in the High Court under Article 226 or an ordinary suit.
Q8. Under Article 33, who can restrict or abrogate the Fundamental Rights of members of the armed forces?
- The President, by order
- Parliament, by law
- State legislatures, by law
- Both Parliament and the state legislatures
Show answer
Answer: B. Parliament, by law
Article 33 gives this power to Parliament by law, and Article 35 makes it Parliament's alone. The President cannot do it by order, and state legislatures have no such power.
