Nature of Indian federalism and legislative relations
Why India is a 'Union of States', its federal and unitary features, the territorial extent of laws, the three lists of the Seventh Schedule, residuary powers, repugnancy, when Parliament can legislate on State subjects, and the doctrines courts use to read the lists.
| List | Who legislates | Examples | In case of overlap |
|---|---|---|---|
| List I: Union List | Parliament only | Defence, foreign affairs, railways, currency, banking, atomic energy | Prevails over Lists II and III |
| List II: State List | State legislature (Parliament only in special cases) | Public order, police, public health and sanitation, agriculture, local government | Yields to Lists I and III |
| List III: Concurrent List | Both Parliament and State legislatures | Criminal law, marriage and divorce, contracts, forests, education, electricity | Union law prevails (Article 254), subject to 254(2) |
| Residuary matters | Parliament only (Article 248) | Any matter or tax not in Lists II and III | Not applicable |
| Article | Trigger | How long the law lasts |
|---|---|---|
| 249 | Rajya Sabha resolution, two-thirds of members present and voting, national interest | Six months after the resolution (one year, renewable) ceases |
| 250 | Proclamation of national emergency in operation | Six months after the emergency ends |
| 252 | Resolutions of two or more State legislatures | Until amended or repealed by Parliament |
| 253 | Implementing a treaty, agreement, convention or international decision | Like any Union law |
| 356/357 | President's Rule in a State (Part 3) | Until altered by the State legislature after President's Rule ends |
Exam traps
- Article 1 calls India a 'Union of States'; the word 'federation' does not appear, and no State may secede.
- Residuary powers lie with Parliament (Article 248), as in Canada, not with the States as in the USA and Australia.
- The 42nd Amendment moved education, forests, weights and measures, wild animals and birds, and administration of justice from the State List to the Concurrent List, not to the Union List.
- Article 249 needs two-thirds of the Rajya Sabha members present and voting, not of the total membership, and the Lok Sabha plays no part.
- A law made under Article 252 can be amended or repealed only by Parliament, not by the States that asked for it.
- Under Article 254(2) a State law prevails over an earlier Union law on a Concurrent subject only if it received the President's assent, and Parliament can still override it later.
- Changing the Seventh Schedule needs a constitutional amendment ratified by at least half the State legislatures.
- Pith and substance saves a law that incidentally touches another list; colourable legislation strikes down a law that does indirectly what the legislature cannot do directly.
Recap
- Article 1: India is a Union of States; not the result of an agreement, no right to secede.
- Federal features: two governments, written supreme Constitution, division of powers, rigid amendment, independent judiciary, Rajya Sabha.
- Unitary features: strong Centre, single citizenship, integrated judiciary, all-India services, Article 3, appointed Governor, emergencies; 'quasi-federal' (K.C. Wheare); federalism is basic structure (S.R. Bommai, 1994).
- Article 245: territorial extent; Union laws may operate outside India.
- Article 246 and the Seventh Schedule: Union, State and Concurrent Lists, with the Union List prevailing in overlap.
- 42nd Amendment (1976): five subjects moved from the State List to the Concurrent List.
- Residuary powers with Parliament (Article 248, Entry 97); Article 254: Union law prevails on Concurrent subjects, except 254(2).
- Parliament on State subjects: Articles 249, 250, 252, 253; Union checks through Articles 200–201, 304(b) and 360(4).
Practice questions
Q1. Which one of the following was NOT moved from the State List to the Concurrent List by the 42nd Amendment Act, 1976?
- Education
- Forests
- Police
- Protection of wild animals and birds
Show answer
Answer: C. Police
Police remains in the State List. The 42nd Amendment moved education, forests, weights and measures, protection of wild animals and birds, and administration of justice to the Concurrent List, so the other three options were all moved.
Q2. In India, the residuary powers of legislation are vested in:
- The State legislatures
- Parliament
- Both Parliament and the State legislatures concurrently
- The President
Show answer
Answer: B. Parliament
Article 248 and Entry 97 of the Union List give Parliament exclusive power over any matter, including any tax, not listed in the State or Concurrent List. India follows Canada here; in the USA and Australia the States hold residuary powers. The President has no law-making power over such matters except through ordinances, which are limited to Parliament's own fields.
Q3. Consider the following statements about Article 249:
1. The resolution must be passed by the Rajya Sabha with a majority of two-thirds of its total membership.
2. A law made under it ceases to have effect six months after the resolution ceases to be in force.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: Article 249 needs not less than two-thirds of the members present and voting, not of the total membership. Statement 2 is correct under Article 249(3). So '1 only', 'both' and 'neither' are wrong.
Q4. Consider the following statements:
1. A law passed by Parliament under Article 252 at the request of two States can be repealed by the legislatures of those States.
2. Any other State may adopt such a law by passing a resolution in its legislature.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: under Article 252(2) such a law can be amended or repealed only by an Act of Parliament. Statement 2 is correct: another State can adopt it by resolution. So '1 only', 'both' and 'neither' are wrong.
Q5. Match List I with List II:
List I (Article)
A. Article 248
B. Article 253
C. Article 254
D. Article 250
List II (Subject)
1. Laws to give effect to international agreements
2. Repugnancy between Union and State laws on Concurrent subjects
3. Residuary powers of legislation
4. Power of Parliament to legislate on State subjects during a national emergency
Select the correct answer using the code given below:
- A-3, B-1, C-2, D-4
- A-1, B-3, C-2, D-4
- A-3, B-2, C-1, D-4
- A-3, B-1, C-4, D-2
Show answer
Answer: A. A-3, B-1, C-2, D-4
Article 248 is residuary power, 253 implements international agreements, 254 deals with repugnancy and 250 with legislation during a national emergency. The second code swaps 248 and 253, the third swaps 253 and 254, and the fourth swaps 254 and 250.
Q6. A State law on a subject in the Concurrent List conflicts with an earlier law made by Parliament. The State law will prevail in that State if:
- It is passed by a two-thirds majority of the State Legislative Assembly
- It has been reserved for the President's consideration and has received the President's assent
- The Governor gives assent to it
- The Rajya Sabha passes a resolution supporting it
Show answer
Answer: B. It has been reserved for the President's consideration and has received the President's assent
Article 254(2) lets such a State law prevail in the State only after it is reserved for and assented to by the President; even then Parliament can later amend or repeal it. A special majority in the Assembly, the Governor's assent or a Rajya Sabha resolution does not cure repugnancy.
Q7. Consider the following statements:
1. The word 'federation' is used in Article 1 of the Constitution of India.
2. In S.R. Bommai v. Union of India (1994), the Supreme Court held federalism to be a basic feature of the Constitution.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: Article 1 says India shall be a 'Union of States', and the word 'federation' is not used. Statement 2 is correct. So '1 only', 'both' and 'neither' are wrong.
Q8. The doctrine under which a law is upheld if its true nature and character falls within the competence of the legislature that made it, even though it incidentally touches a subject in another list, is known as:
- Colourable legislation
- Pith and substance
- Eclipse
- Severability
Show answer
Answer: B. Pith and substance
Pith and substance looks at the true character of a law, as in State of Bombay v. F.N. Balsara (1951). Colourable legislation does the opposite, striking down a law that does indirectly what cannot be done directly; eclipse and severability are doctrines about Fundamental Rights and partly invalid laws, not about the division of the lists.
