Vice-President, Prime Minister, Council of Ministers and Attorney General
How the Vice-President is elected and removed and acts for the President; how the Prime Minister is appointed; the Council of Ministers, its size cap and collective responsibility to the Lok Sabha; the conduct of government business; and the Attorney General.
(→ English: Council of Ministers · हिन्दी: मंत्रिपरिषद)

(→ English: Council of Ministers · हिन्दी: मंत्रिपरिषद)
(→ English: Council of Ministers · हिन्दी: मंत्रिपरिषद)
Exam traps
- Nominated MPs vote in the Vice-President's election but not in the President's; State MLAs vote only in the President's.
- The Vice-President is removed by a Rajya Sabha resolution agreed to by the Lok Sabha, not by impeachment, and the Constitution states no ground for removal.
- The Vice-President takes the oath before the President; the President takes it before the Chief Justice of India.
- Acting as President, the Vice-President does not preside over the Rajya Sabha or draw the Chairman's salary, and acts only until a new President is elected within six months.
- The 91st Amendment's 15 per cent cap is measured against the Lok Sabha alone and includes the Prime Minister; in States the floor is 12 ministers.
- Collective responsibility is to the Lok Sabha only; ministers hold office individually during the President's pleasure (Article 75(2)).
- The word 'Cabinet' appears in the Constitution only through the 44th Amendment, in Article 352.
- The Attorney General has no fixed term, may speak in Parliament but cannot vote, and is not a member of the Cabinet; the Solicitor General is not a constitutional office.
Recap

Practice questions
Q1. Consider the following statements about the election of the Vice-President of India:
1. Nominated members of Parliament have a vote in the election.
2. Elected members of the State Legislative Assemblies have a vote in the election.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Article 66 gives the vote to all members of both Houses of Parliament, nominated members included, so statement 1 is correct. State legislators vote for the President, not the Vice-President, so statement 2 is wrong. Hence '2 only', 'both' and 'neither' are wrong.
Q2. The Vice-President of India can be removed from office by:
- Impeachment by both Houses on the ground of violation of the Constitution
- A resolution of the Rajya Sabha passed by a majority of all its then members and agreed to by the Lok Sabha
- A resolution of the Lok Sabha passed by a two-thirds majority and agreed to by the Rajya Sabha
- The President on the advice of the Council of Ministers
Show answer
Answer: B. A resolution of the Rajya Sabha passed by a majority of all its then members and agreed to by the Lok Sabha
Article 67(b): the resolution starts in the Rajya Sabha, needs a majority of all its then members, must be agreed to by the Lok Sabha, and needs 14 days' notice. Impeachment applies to the President, not the Vice-President; the Lok Sabha cannot start the resolution; and the President has no power to remove the Vice-President.
Q3. With reference to the Constitution (Ninety-first Amendment) Act, 2003, consider the following statements:
1. The total number of ministers, including the Prime Minister, shall not exceed 15 per cent of the total number of members of both Houses of Parliament.
2. The number of ministers in a State, including the Chief Minister, shall not be less than 12.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: Article 75(1A) measures the 15 per cent cap against the Lok Sabha alone, not both Houses. Statement 2 is correct under the proviso to Article 164(1A). So '1 only', 'both' and 'neither' are wrong.
Q4. Under the Constitution of India, the Council of Ministers is collectively responsible to:
- The President
- Parliament as a whole
- The Lok Sabha
- The Prime Minister
Show answer
Answer: C. The Lok Sabha
Article 75(3) makes the Council collectively responsible to the House of the People alone. Ministers hold office during the President's pleasure (Article 75(2)), but that is individual tenure, not collective responsibility; the Rajya Sabha cannot remove the government, so 'Parliament as a whole' is wrong; and the Prime Minister heads the Council rather than being the body it answers to.
Q5. Match List I with List II:
List I (Article)
A. Article 67
B. Article 75(5)
C. Article 76
D. Article 78
List II (Subject)
1. Attorney General for India
2. Duties of the Prime Minister to inform the President
3. Term and removal of the Vice-President
4. Minister who is not a member of Parliament for six consecutive months
Select the correct answer using the code given below:
- A-3, B-4, C-1, D-2
- A-4, B-3, C-1, D-2
- A-3, B-4, C-2, D-1
- A-1, B-4, C-3, D-2
Show answer
Answer: A. A-3, B-4, C-1, D-2
Article 67 covers the Vice-President's term and removal, 75(5) the six-month rule for non-member ministers, 76 the Attorney General and 78 the Prime Minister's duties. The second code swaps 67 and 75(5), the third swaps 76 and 78, and the fourth puts the Attorney General against Article 67.
Q6. Consider the following statements about the Attorney General for India:
1. The Attorney General holds office for a fixed term of five years.
2. The Attorney General may take part in the proceedings of either House of Parliament but has no right to vote.
3. The Attorney General must be qualified to be appointed a judge of the Supreme Court.
Which of the statements given above are correct?
- 1 and 2 only
- 2 and 3 only
- 1 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 2 and 3 only
Statement 1 is wrong: Article 76(4) says the Attorney General holds office during the pleasure of the President, with no fixed term. Statement 2 follows Article 88 and statement 3 Article 76(1). Every code containing 1 is therefore wrong.
Q7. The word 'Cabinet' was inserted into the Constitution of India by:
- The 42nd Amendment, in Article 74
- The 44th Amendment, in Article 352
- The 91st Amendment, in Article 75
- It has been in Article 75 since 1950
Show answer
Answer: B. The 44th Amendment, in Article 352
The 44th Amendment (1978) required a written decision of the Union Cabinet before a national emergency is proclaimed under Article 352, bringing the word into the Constitution. The 42nd Amendment made ministerial advice binding in Article 74 without using the word; the 91st Amendment capped the size of the Council of Ministers; and the original Constitution spoke only of a Council of Ministers.
Q8. While the Vice-President of India is acting as President, the Vice-President:
- Continues to preside over the Rajya Sabha
- Draws the salary of the Chairman of the Rajya Sabha
- Has all the powers, immunities and emoluments of the President
- Becomes President for the rest of the former President's term
Show answer
Answer: C. Has all the powers, immunities and emoluments of the President
Article 65(3) gives the acting Vice-President all the President's powers, immunities and emoluments. Under Article 64 the Vice-President does not perform the Chairman's duties or draw the Chairman's salary during that time, and Article 62 requires a new President to be elected within six months, so the Vice-President does not serve out the former President's term.
