Part IV in depth: the Directive Principles and how they are carried out
Part IV of the Constitution: the non-justiciable but fundamental character of the Directive Principles, their socialist, Gandhian and liberal-intellectual groups, the principles added by later amendments, directions outside Part IV, the laws and schemes that carry them out and how courts use them.
(→ English: Directive Principles of State Policy · हिन्दी: राज्य की नीति के निदेशक तत्व)
| Family | Idea behind it | Articles |
|---|---|---|
| Socialist | Economic justice, welfare, a fair deal for workers | 38, 39, 39A, 41, 42, 43, 43A, 47 (nutrition, public health) |
| Gandhian | Village self-government, rural industry, protection of the weak | 40, 43 (cottage industries), 43B, 46, 47 (prohibition), 48 (cattle) |

(→ English: Directive Principles of State Policy · हिन्दी: राज्य की नीति के निदेशक तत्व)
(→ English: Directive Principles of State Policy · हिन्दी: राज्य की नीति के निदेशक तत्व)
Exam traps
- Directive Principles are non-justiciable (Article 37) but are still 'fundamental in the governance of the country'; do not call them merely advisory.
- The idea of Directive Principles came from the Irish Constitution; the idea of Fundamental Duties is traced to the former USSR.
- Article 39A (free legal aid), 43A (workers in management) and 48A (environment) were added by the 42nd Amendment; 38(2) by the 44th; 43B by the 97th.
- Article 45 now speaks of early childhood care and education up to six years; education for children of six to fourteen is the Fundamental Right in Article 21A.
- Equal pay for equal work for men and women is in Article 39(d), a Directive Principle, not a Fundamental Right in Part III.
- Separation of the judiciary from the executive is Article 50; protection of monuments is Article 49; international peace is Article 51.
- Articles 335, 350A and 351 are directions outside Part IV; a statement placing them in Part IV is wrong.
- The socialist, Gandhian and liberal-intellectual grouping is a study device; the Constitution itself does not classify the principles.
Recap
- Part IV, Articles 36–51; 'State' as in Article 12; Article 37: not enforceable by any court, yet fundamental in governance.
- Source: the Irish Constitution; compared by Dr Ambedkar to the Instrument of Instructions under the Government of India Act, 1935.
- Socialist: Articles 38, 39 (a)–(f), 39A, 41, 42, 43, 43A, 47; aims at economic justice and welfare.
- Gandhian: Articles 40, 43 (cottage industries), 43B, 46, 47 (prohibition), 48 (cattle).
- Liberal-intellectual: Articles 44 (Uniform Civil Code), 45, 48 (scientific agriculture), 48A, 49, 50, 51.
- Later additions: 42nd (39(f) reworded, 39A, 43A, 48A), 44th (38(2)), 86th (new Article 45 with 21A), 97th (43B).
- Directions outside Part IV: Article 335 (services), 350A (mother tongue at primary stage), 351 (Hindi).
- Carried out through laws: land reforms, Legal Services Authorities Act 1987, 73rd Amendment, MGNREGA 2005, NFSA 2013, environment laws, CrPC 1973.
- Courts read the principles into Article 21: Hussainara Khatoon (1979) on legal aid and speedy trial; Unni Krishnan (1993) on education.
Practice questions
Q1. Which Article of the Constitution of India declares that the Directive Principles shall not be enforced by any court but are fundamental in the governance of the country?
- Article 36
- Article 37
- Article 38
- Article 51
Show answer
Answer: B. Article 37
Article 37 states both points. Article 36 only defines 'the State' for Part IV; Article 38 asks for a social order based on justice; Article 51 concerns international peace and security.
Q2. Which of the following Directive Principles were added by the Constitution (Forty-second Amendment) Act, 1976?
1. Equal justice and free legal aid
2. Participation of workers in the management of industries
3. Promotion of co-operative societies
4. Protection and improvement of the environment
Select the correct answer using the code given below.
- 1, 2 and 4 only
- 1 and 3 only
- 2, 3 and 4 only
- 1, 2, 3 and 4
Show answer
Answer: A. 1, 2 and 4 only
The 42nd Amendment added Articles 39A, 43A and 48A. Article 43B on co-operative societies came with the 97th Amendment (2011), so every option containing item 3 is wrong.
Q3. Consider the following statements:
1. Article 45 of the Constitution, in its present form, directs the State to provide early childhood care and education for all children until they complete the age of six years.
2. Free and compulsory education for children aged six to fourteen years is a Directive Principle under Article 41.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct: the 86th Amendment (2002) rewrote Article 45 in these terms. Statement 2 is wrong: the same amendment made education for children of six to fourteen a Fundamental Right under Article 21A. So '2 only' and 'both' are wrong, and 'neither' ignores statement 1.
Q4. Match List I with List II:
List I (Article)
A. Article 40
B. Article 44
C. Article 48A
D. Article 50
List II (Subject)
1. Uniform Civil Code
2. Separation of judiciary from executive
3. Organisation of village panchayats
4. Protection of environment, forests and wildlife
Select the correct answer using the code given below.
- A-3, B-1, C-4, D-2
- A-1, B-3, C-4, D-2
- A-3, B-1, C-2, D-4
- A-2, B-1, C-4, D-3
Show answer
Answer: A. A-3, B-1, C-4, D-2
Article 40 is village panchayats, 44 the Uniform Civil Code, 48A the environment and 50 the separation of the judiciary. The second option swaps Articles 40 and 44; the third swaps 48A and 50; the fourth swaps 40 and 50.
Q5. Which one of the following is NOT usually classed among the Gandhian Directive Principles?
- Organisation of village panchayats (Article 40)
- Promotion of cottage industries in rural areas (Article 43)
- Prohibition of intoxicating drinks injurious to health (Article 47)
- Separation of the judiciary from the executive (Article 50)
Show answer
Answer: D. Separation of the judiciary from the executive (Article 50)
Article 50 belongs to the liberal-intellectual group, reflecting a modern state's idea of an independent judiciary. Village panchayats, cottage industries and prohibition all come from Gandhi's programme, so the first three options are Gandhian.
Q6. With reference to the Constitution of India, which of the following directions to the State are found outside Part IV?
1. Instruction in the mother tongue at the primary stage for children of linguistic minority groups
2. Development of the Hindi language
3. Promotion of international peace and security
Select the correct answer using the code given below.
- 1 and 2 only
- 2 and 3 only
- 1 and 3 only
- 1, 2 and 3
Show answer
Answer: A. 1 and 2 only
Mother-tongue instruction is Article 350A and the development of Hindi is Article 351, both in Part XVII. International peace and security is Article 51, inside Part IV, so every option containing item 3 is wrong.
Q7. Consider the following pairs:
1. Legal Services Authorities Act, 1987 : Article 39A
2. Mahatma Gandhi National Rural Employment Guarantee Act, 2005 : Article 41
3. Ancient Monuments and Archaeological Sites and Remains Act, 1958 : Article 48A
Which of the pairs given above are correctly matched?
- 1 and 2 only
- 2 and 3 only
- 1 and 3 only
- 1, 2 and 3
Show answer
Answer: A. 1 and 2 only
Pairs 1 and 2 are correct: legal aid serves Article 39A and rural employment serves the right to work in Article 41. Pair 3 is wrong: the monuments law serves Article 49; Article 48A is the environment. So every option containing pair 3 is wrong.
Q8. In which case did the Supreme Court, relying on Article 39A, hold that free legal aid and a speedy trial are part of the right to life and personal liberty under Article 21?
- Hussainara Khatoon v. Home Secretary, State of Bihar (1979)
- J.P. Unni Krishnan v. State of Andhra Pradesh (1993)
- Kesavananda Bharati v. State of Kerala (1973)
- Minerva Mills v. Union of India (1980)
Show answer
Answer: A. Hussainara Khatoon v. Home Secretary, State of Bihar (1979)
Hussainara Khatoon (1979), on long-detained undertrial prisoners, is the case. Unni Krishnan (1993) concerned the right to education; Kesavananda (1973) laid down the basic structure doctrine; Minerva Mills (1980) struck down Article 368(4) and (5) and stressed the balance between rights and principles.
