Exploitation, Religion, Culture and Education (Articles 23–30)
The Right against Exploitation (Articles 23–24), the Right to Freedom of Religion and what Indian secularism means (Articles 25–28), and the Cultural and Educational Rights of minorities and other groups (Articles 29–30).
| Type of institution | Religious instruction |
|---|---|
| Wholly maintained out of State funds | Not allowed |
| Administered by the State but set up under a trust requiring religious instruction | Allowed |
| Recognised by the State or receiving State aid | Allowed, but only with the consent of the student (or guardian, for a minor) |
| Article 29 | Article 30 | |
|---|---|---|
| Who is protected | Any section of citizens with a distinct language, script or culture | Minorities, religious or linguistic |
| What it protects | Conserving language, script, culture; admission without discrimination | Establishing and administering educational institutions |
| Limited to minorities? | No | Yes |
Exam traps
- Articles 23 and 24 apply against private persons too; Article 23 protects non-citizens as well.
- Compulsory service for public purposes (such as military service) is allowed under Article 23(2), without discrimination on religion, race, caste or class.
- Article 24 fixes the age at 14 and covers factories, mines and other hazardous employment; the 2016 law goes further than the Constitution.
- Article 25 is for all persons; it is subject to public order, morality, health and the other provisions of Part III. Article 26 is subject only to public order, morality and health.
- For Article 25, 'Hindus' includes Sikhs, Jains and Buddhists; wearing a kirpan is part of the Sikh religion.
- The right to propagate religion is not a right to convert another person (Rev. Stainislaus, 1977).
- Article 27 bars a tax for one religion, not a fee for services.
- Article 29 protects any section of citizens, not only minorities; Article 30 is only for religious and linguistic minorities, decided state by state (T.M.A. Pai, 2002).
Recap
- Article 23: no trafficking, begar or forced labour; paying below minimum wage is forced labour (PUDR 1982); compulsory public service allowed.
- Article 24: no child below 14 in factories, mines or hazardous work.
- Indian secularism: equal respect for all religions, no State religion, freedom to reform; part of the basic structure (S.R. Bommai 1994).
- Article 25: conscience; profess, practise, propagate; State may regulate secular activities and reform; kirpan; 'Hindus' includes Sikhs, Jains, Buddhists.
- Article 26: denominations manage their religious affairs and property; essential religious practices test (Shirur Mutt 1954).
- Article 27: no tax to promote a particular religion. Article 28: no religious instruction in wholly State-funded institutions.
- Article 29: any section of citizens may conserve its language, script, culture; no denial of admission on religion, race, caste, language.
- Article 30: minorities may establish and administer educational institutions; minority status decided state by state (T.M.A. Pai 2002).
Practice questions
Q1. Consider the following statements about Article 23:
1. It protects people only against action by the State.
2. The State may impose compulsory service for public purposes, such as military service.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 2 is correct under Article 23(2). Statement 1 is wrong: Article 23 applies against private persons as well, for example an employer who keeps bonded labourers.
Q2. In People's Union for Democratic Rights v. Union of India (1982), the Supreme Court held that paying a worker less than the minimum wage violates which article?
- Article 19, as a restriction on the freedom of profession
- Article 23, as forced labour
- Article 24, as child labour
- Article 17, as a form of untouchability
Show answer
Answer: B. Article 23, as forced labour
The Court treated work for less than the minimum wage as forced labour under Article 23. The case was about adult construction workers, so Article 24 did not apply, and it concerned wages, not untouchability or the freedom of profession.
Q3. For the purposes of Article 25, the reference to 'Hindus' includes persons professing which of the following religions?
1. Sikh
2. Jaina
3. Buddhist
4. Parsi
Select the correct answer using the code below.
- 1 and 2 only
- 1, 2 and 3 only
- 2, 3 and 4 only
- 1, 2, 3 and 4
Show answer
Answer: B. 1, 2 and 3 only
Explanation II to Article 25 says 'Hindus' includes persons professing the Sikh, Jaina or Buddhist religion. Parsis are not included, so options containing 4 are wrong.
Q4. Consider the following statements:
1. The freedom of religion under Article 25 is expressly subject to the other provisions of Part III.
2. The rights of religious denominations under Article 26 are expressly subject to the other provisions of Part III.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Article 25(1) begins 'Subject to public order, morality and health and to the other provisions of this Part'. Article 26 is expressly subject only to public order, morality and health, so statement 2 is wrong.
Q5. A state government charges pilgrims a fee for the facilities it maintains at a shrine. Another state levies a tax whose proceeds go only to maintaining temples of one community. Which statement is correct under Article 27?
- Both are valid
- Both violate Article 27
- The fee is valid; the tax violates Article 27
- The tax is valid; the fee violates Article 27
Show answer
Answer: C. The fee is valid; the tax violates Article 27
Article 27 bars taxes whose proceeds are specifically appropriated to promote or maintain a particular religion. A fee is a charge for a service, not a tax, so it does not fall under Article 27.
Q6. With reference to Article 28, consider the following statements:
1. No religious instruction can be given in an educational institution wholly maintained out of State funds.
2. In a State-aided institution, students can be required to attend religious instruction.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is Article 28(1). Statement 2 is wrong: under Article 28(3), attendance in recognised or aided institutions needs the consent of the student, or the guardian for a minor.
Q7. According to the Supreme Court in T.M.A. Pai Foundation v. State of Karnataka (2002), at what level is a religious or linguistic minority to be determined for the purposes of Article 30?
- The whole of India
- Each state
- Each district
- Each institution
Show answer
Answer: B. Each state
The eleven-judge bench held that because states were reorganised on linguistic lines, minorities for Article 30 are to be identified state by state, not on a national, district or institution basis.
Q8. Consider the following statements:
1. Article 29 protects only religious and linguistic minorities.
2. Article 30 covers both religious and linguistic minorities.
3. The Constitution defines the term 'minority'.
Which of the statements given above is/are correct?
- 2 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: A. 2 only
Only statement 2 is correct. Statement 1 is wrong: Article 29 protects any section of citizens with a distinct language, script or culture. Statement 3 is wrong: the Constitution does not define 'minority'.
