Salient features, sources, Parts and Schedules
What kind of document the Constitution is: its adoption and commencement, its length, the sources it borrowed from (the 1935 Act and ten other constitutions), its blend of rigidity and flexibility, federalism with a unitary bias, parliamentary government, an integrated judiciary, the three layers of rights and duties, secularism, adult franchise, safety valves, and a map of its 25 Parts and 12 Schedules.
Exam traps
- Adopted on 26 November 1949, in force on 26 January 1950; citizenship and election provisions took effect on 26 November 1949 itself (Article 394).
- Originally 395 Articles, 22 Parts and 8 Schedules; now 25 Parts and 12 Schedules, yet the last Article is still numbered 395.
- Directive Principles came from Ireland and Fundamental Duties from the former USSR; the Concurrent List from Australia; residuary powers with the Centre from Canada.
- 'Procedure established by law' in Article 21 comes from Japan, not the American 'due process of law'; the amendment procedure is traced to South Africa.
- Article 1 calls India a 'Union of States'; the word 'federation' does not appear in the Constitution.
- Creating or abolishing a State Legislative Council (Article 169) needs only a simple majority in Parliament and is not an amendment under Article 368.
- The 61st Amendment (1988) lowered the voting age from 21 to 18; the 42nd Amendment (1976) added 'secular' and the Fundamental Duties.
- Ninth Schedule: 1st Amendment (1951); Tenth: 52nd (1985); Eleventh: 73rd (29 subjects); Twelfth: 74th (18 subjects).

Practice questions
Q1. The idea of the Directive Principles of State Policy in the Constitution of India was borrowed from the Constitution of
- the United States
- Ireland
- Canada
- the former USSR
Show answer
Answer: B. Ireland
Directive Principles were modelled on the Irish Constitution. The United States gave Fundamental Rights and judicial review, Canada a federation with a strong Centre, and the former USSR the Fundamental Duties.
Q2. Consider the following statements:
1. As originally adopted, the Constitution of India had 395 Articles in 22 Parts and 8 Schedules.
2. The Tenth Schedule was added by the Constitution (First Amendment) Act, 1951.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct. Statement 2 is wrong: the 1st Amendment added the Ninth Schedule; the Tenth (anti-defection) came with the 52nd Amendment in 1985. So '2 only' and 'Both' are wrong, and 'Neither' ignores statement 1.
Q3. Match List I with List II:
List I (Schedule) — List II (Content)
A. Fourth Schedule — 1. Languages
B. Sixth Schedule — 2. Allocation of seats in the Rajya Sabha
C. Eighth Schedule — 3. Subjects for panchayats
D. Eleventh Schedule — 4. Tribal areas of Assam, Meghalaya, Tripura and Mizoram
Select the correct answer using the code given below:
- A-2, B-4, C-1, D-3
- A-4, B-2, C-1, D-3
- A-2, B-4, C-3, D-1
- A-1, B-4, C-2, D-3
Show answer
Answer: A. A-2, B-4, C-1, D-3
The Fourth Schedule allocates Rajya Sabha seats, the Sixth covers tribal areas of the four north-eastern States, the Eighth lists languages and the Eleventh lists panchayat subjects. The second option swaps the Fourth and Sixth, the third swaps the Eighth and Eleventh, and the fourth swaps the Fourth and Eighth.
Q4. Consider the following statements:
1. Article 1 of the Constitution describes India as a 'Union of States'.
2. A single citizenship and an integrated judiciary are among the unitary features of the Constitution.
3. The word 'federation' is used in Article 1 to describe India.
Which of the statements given above is/are correct?
- 1 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 2 only
Statements 1 and 2 are correct. Statement 3 is wrong: the Constitution never uses the word 'federation'; Ambedkar explained that the Union did not result from an agreement among the States. '1 only' misses statement 2, and the options containing 3 are wrong.
Q5. Which one of the following can be done by Parliament by a simple majority, without an amendment under Article 368?
- Changing the manner of election of the President
- Abolishing the Legislative Council of a State
- Changing the distribution of legislative powers between the Union and the States
- Abridging a Fundamental Right
Show answer
Answer: B. Abolishing the Legislative Council of a State
Article 169 lets Parliament create or abolish a Legislative Council by law, on the State Assembly's resolution, and says such a law is not an amendment under Article 368. The President's election and the distribution of legislative powers need a special majority plus ratification by half the States, and abridging a Fundamental Right needs a special majority under Article 368.
Q6. Consider the following statements:
1. The voting age was lowered from 21 to 18 years by the Constitution (Sixty-first Amendment) Act, 1988.
2. The word 'secular' has been part of the Preamble since the Constitution came into force in 1950.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct. Statement 2 is wrong: 'secular' was added to the Preamble by the 42nd Amendment in 1976, though the idea runs through Articles 25–28 from the start. So '2 only' and 'Both' are wrong, and 'Neither' ignores statement 1.
Q7. Consider the following statements:
1. Fundamental Duties were added to the Constitution as Part IVA by the 42nd Amendment, 1976.
2. The Directive Principles of State Policy can be enforced by the courts.
3. Under Article 75(3), the Council of Ministers is collectively responsible to the Lok Sabha.
Which of the statements given above is/are correct?
- 1 only
- 1 and 3 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 3 only
Statements 1 and 3 are correct. Statement 2 is wrong: Article 37 says the Directive Principles shall not be enforceable by any court, though they are fundamental in governance. '1 only' misses statement 3, and the options containing 2 are wrong.
Q8. With reference to the Ninth Schedule, consider the following statements:
1. It was added by the Constitution (First Amendment) Act, 1951.
2. According to I.R. Coelho v. State of Tamil Nadu (2007), laws placed in it after 24 April 1973 can be tested against the basic structure.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: C. Both 1 and 2
Both are correct: the 1st Amendment created the Ninth Schedule to protect land-reform laws, and Coelho held that laws added after the Kesavananda Bharati judgment of 24 April 1973 are open to basic-structure review. '1 only' and '2 only' each miss a correct statement, and 'Neither' misses both.
