Election Commission, Public Service Commissions and Finance Commission
What makes a body constitutional; the Election Commission under Article 324 (appointment after Anoop Baranwal and the 2023 Act, removal, Seshan, Articles 325–329, symbols and the Model Code); the UPSC and State Public Service Commissions (Articles 315–323: appointment, removal, functions, non-binding advice); and the Finance Commission under Articles 280–281.
Exam traps
- The Election Commission runs elections to Parliament, State legislatures and the offices of President and Vice-President; panchayat and municipal elections belong to State Election Commissions (Articles 243K, 243ZA).
- Only the Chief Election Commissioner is removable like a Supreme Court judge; an Election Commissioner other than him cannot be removed except on the Chief Election Commissioner's recommendation (Article 324(5)).
- Anoop Baranwal (2023) put the Chief Justice of India on an interim selection committee; the 2023 Act replaced him with a Union Cabinet Minister nominated by the Prime Minister.
- After T.N. Seshan (1995) the Chief Election Commissioner and the other Commissioners are equals, and the Commission decides by majority.
- A State Public Service Commission member is appointed by the Governor but can be removed only by the President; for misbehaviour the Supreme Court's inquiry comes first.
- Retirement age: 65 in the UPSC, 62 in State and Joint Commissions (raised from 60 by the 41st Amendment, 1976); the term is six years in all of them.
- A Joint State Public Service Commission is created by a law of Parliament, so it is a statutory body; the UPSC Chairman cannot take any further government job.
- The Finance Commission has a chairman and four members, but their qualifications come from the 1951 Act, not the Constitution; it is temporary and advisory, as is the advice of Public Service Commissions (Manbodhan Lal Srivastava, 1957).
Recap
- Constitutional bodies are created by the Constitution and changed only by amendment; independence comes from tenure, removal rules and protected service conditions.
- Election Commission (Article 324): elections to Parliament, State legislatures, President and Vice-President; multi-member since 1993.
- Appointment under the 2023 Act (selection committee of the Prime Minister, Leader of the Opposition and a Cabinet Minister); six years or age 65.
- Chief Election Commissioner removable only like a Supreme Court judge; others on his recommendation; members equal (Seshan, 1995).
- Articles 325–329: one roll, adult suffrage at 18 (61st Amendment), election laws, bar on courts; Election Commission also recognises parties and allots symbols.
- Public Service Commissions (Articles 315–323): UPSC, State and Joint; six years or 65/62; removal only by the President after a Supreme Court inquiry for misbehaviour.
- Consultation on recruitment, promotion and discipline, but not on reservation; advice not binding (Manbodhan Lal Srivastava, 1957).
- Finance Commission (Article 280): every five years, chairman and four members, tax sharing and grants; Fifteenth (N.K. Singh, 41 per cent), Sixteenth (Arvind Panagariya, 2026–31).
Practice questions
Q1. Which one of the following elections is NOT conducted by the Election Commission of India?
- Election of the President
- Election of the Vice-President
- Election to the Rajya Sabha
- Election to a Municipal Corporation
Show answer
Answer: D. Election to a Municipal Corporation
Municipal elections are conducted by the State Election Commission under Article 243ZA. Article 324 gives the Election Commission of India the elections of the President, the Vice-President and both Houses of Parliament, so the first three options are wrong.
Q2. Consider the following statements about the Election Commission:
1. The Chief Election Commissioner can be removed only in the manner and on the grounds of a Supreme Court judge.
2. An Election Commissioner other than the Chief Election Commissioner cannot be removed from office except on the recommendation of the Chief Election Commissioner.
3. The Constitution fixes the number of Election Commissioners at two.
Which of the statements given above is/are correct?
- 1 only
- 1 and 2 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 2 only
Statement 1 restates Article 324(5). Statement 2 restates its proviso: the other Election Commissioners are protected because their removal needs the Chief Election Commissioner's recommendation. Statement 3 is wrong: Article 324(2) lets the President fix the number of Election Commissioners from time to time. '1 only' misses statement 2, and the options containing 3 are wrong.
Q3. Under the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, the selection committee consists of:
- the Prime Minister, the Leader of the Opposition in the Lok Sabha and the Chief Justice of India
- the Prime Minister, the Leader of the Opposition in the Lok Sabha and a Union Cabinet Minister nominated by the Prime Minister
- the President, the Prime Minister and the Chief Justice of India
- the Prime Minister, the Speaker of the Lok Sabha and the Leader of the Opposition
Show answer
Answer: B. the Prime Minister, the Leader of the Opposition in the Lok Sabha and a Union Cabinet Minister nominated by the Prime Minister
The 2023 Act names the Prime Minister, the Leader of the Opposition (or leader of the largest opposition party) and a Cabinet Minister nominated by the Prime Minister. The first option is the interim committee set by Anoop Baranwal (2023), which the Act replaced; the President and the Speaker are not members.
Q4. The voting age was lowered from 21 to 18 years by which Constitution Amendment Act?
- 42nd Amendment, 1976
- 44th Amendment, 1978
- 61st Amendment, 1988
- 73rd Amendment, 1992
Show answer
Answer: C. 61st Amendment, 1988
The 61st Amendment Act, 1988 amended Article 326. The 42nd and 44th Amendments dealt with other matters, such as the emergency provisions, and the 73rd created Part IX on panchayats.
Q5. Consider the following statements:
1. A member of a State Public Service Commission is appointed by the Governor and can be removed by the Governor.
2. The Chairman of the Union Public Service Commission is not eligible for further employment under the Government of India or a State government.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: the Governor appoints and may suspend, but only the President can remove a State Commission member (Article 317). Statement 2 is correct under Article 319. So '1 only' and 'Both' are wrong, and 'Neither' ignores statement 2.
Q6. Match List I (Article) with List II (subject):
List I
A. Article 315
B. Article 317
C. Article 320
D. Article 323
List II
1. Reports of Public Service Commissions
2. Removal and suspension of members
3. Public Service Commissions for the Union and the States
4. Functions of Public Service Commissions
Select the correct answer using the code given below.
- A-3, B-2, C-4, D-1
- A-3, B-4, C-2, D-1
- A-2, B-3, C-4, D-1
- A-1, B-2, C-3, D-4
Show answer
Answer: A. A-3, B-2, C-4, D-1
315 creates the Commissions, 317 covers removal and suspension, 320 their functions and 323 their reports. The second option swaps 317 and 320, the third swaps 315 and 317, and the fourth matches only B correctly.
Q7. In State of U.P. v. Manbodhan Lal Srivastava (1957), the Supreme Court held that the requirement to consult the Public Service Commission under Article 320(3) is:
- mandatory, so action without consultation is void
- directory, so action without consultation is not void for that reason alone
- applicable only to the Union Public Service Commission
- a Fundamental Right of civil servants
Show answer
Answer: B. directory, so action without consultation is not void for that reason alone
The Court held the provision directory, so the Commission's advice does not bind the government. It did not hold it mandatory; Article 320 applies to State Commissions too; and consultation is not a Fundamental Right.
Q8. Consider the following statements about the Finance Commission:
1. The qualifications of its members are laid down by a law of Parliament.
2. It is a permanent body.
3. It recommends measures to augment a State's Consolidated Fund to supplement the resources of panchayats and municipalities.
Which of the statements given above is/are correct?
- 1 and 2 only
- 1 and 3 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 3 only
Statements 1 and 3 are correct: the 1951 Act sets qualifications, and Article 280(3) includes the duty on panchayats and municipalities. Statement 2 is wrong because each Commission is constituted afresh, at least every five years, so any option containing 2 is wrong.
