Citizenship: Part II and the Citizenship Act, 1955
Who is a citizen of India: single citizenship and the rights reserved for citizens, Articles 5 to 11, the five ways of acquiring citizenship and three ways of losing it under the Citizenship Act, 1955, Overseas Citizens of India, the 2003 and 2019 amendments, and Section 6A for Assam.
| Born in India | Who is a citizen by birth | Rule set by |
|---|---|---|
| 26 Jan 1950 to 30 Jun 1987 | Everyone, whatever the parents' nationality | Original Act, 1955 |
| 1 Jul 1987 to 2 Dec 2004 | Only if at least one parent is a citizen | 1986 amendment |
| From 3 Dec 2004 | Both parents citizens, or one a citizen and the other not an illegal migrant | 2003 amendment |
| Way | How it happens | Applies to |
|---|---|---|
| Renunciation (s. 8) | Voluntary declaration, effective on registration | An adult citizen who also holds another nationality |
| Termination (s. 9) | Automatic on voluntarily acquiring another country's citizenship | Any citizen |
| Deprivation (s. 10) | Compulsory order of the Central Government on listed grounds | Citizens by registration or naturalisation |
Exam traps
- Part II (Articles 5–11) only settles who was a citizen at the commencement; acquisition and loss after 1950 are governed by the Citizenship Act, 1955, made under Article 11.
- Article 6's cut-off for migrants from Pakistan is 19 July 1948; Article 7's date for migrants to Pakistan is 1 March 1947. Do not swap them.
- Birth in India alone made a person a citizen only for births up to 30 June 1987; after that the parents' status decides.
- Naturalisation needs twelve months' stay plus eleven of the fourteen years before that; the 2019 amendment cuts eleven to five only for six named communities from Afghanistan, Bangladesh and Pakistan.
- Termination is automatic on voluntarily taking foreign citizenship; deprivation needs a Central Government order and applies only to citizens by registration or naturalisation.
- An OCI cardholder is a foreign national: no vote, no seat in a legislature, no constitutional office; anyone who or whose parent or grandparent was ever a citizen of Pakistan or Bangladesh is excluded.
- Keep the dates apart: 31 December 2014 for the 2019 amendment; 1 January 1966 and 25 March 1971 for Assam's Section 6A.
- Single citizenship does not bar every residence rule: Article 16(3) lets Parliament require residence within a State for certain jobs there.
Recap
- Single citizenship: no separate State citizenship; Articles 15, 16, 19, 29 and 30, voting and high offices are for citizens only.
- Article 5: domicile plus birth, a parent's birth or five years' residence; Article 6: migrants from Pakistan (19 July 1948).
- Article 7: migrants to Pakistan after 1 March 1947; Article 8: persons of Indian origin abroad; Article 9: voluntary foreign citizenship bars; Articles 10–11: Parliament regulates.
- Five ways in: birth, descent, registration, naturalisation, incorporation of territory.
- Birth rule tightened in 1986 (one parent a citizen) and 2003 (both, or one and the other not an illegal migrant).
- Three ways out: renunciation (voluntary), termination (automatic), deprivation (Government order).
- OCI (2003, widened 2005, merged with PIO in 2015): lifelong visa, no political rights, not dual citizenship.
- 2019 amendment: six communities from three countries, entry by 31 December 2014, five years for naturalisation; Section 6A for Assam upheld in 2024.
Practice questions
Q1. Which Article of the Constitution of India empowers Parliament to make any provision with respect to the acquisition and termination of citizenship?
- Article 5
- Article 9
- Article 10
- Article 11
Show answer
Answer: D. Article 11
Article 11 gives Parliament this power, and the Citizenship Act, 1955 was made under it. Article 5 covers citizenship at the commencement, Article 9 bars those who voluntarily took foreign citizenship, and Article 10 only continues existing citizens subject to Parliament's law.
Q2. Consider the following statements:
1. A person born in India in 1980 to two foreign nationals, neither of whom is a diplomat or an enemy alien, is a citizen of India by birth.
2. A person born in India in 2010 whose mother is an Indian citizen and whose father is an illegal migrant is a citizen of India by birth.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct: for births before 1 July 1987, birth in India was enough. Statement 2 is wrong: for births from 3 December 2004, a child with an illegal-migrant parent is not a citizen by birth even if the other parent is a citizen. So '2 only' and 'both' are wrong, and 'neither' ignores statement 1.
Q3. Match List I with List II:
List I (Mode under the Citizenship Act)
A. Renunciation
B. Termination
C. Deprivation
D. Naturalisation
List II (Feature)
1. Order of the Central Government against a citizen by registration or naturalisation
2. Automatic on voluntarily acquiring another country's citizenship
3. Declaration by an adult citizen who also holds another nationality
4. Grant after meeting the residence conditions of the Third Schedule
Select the correct answer using the code given below:
- A-3, B-2, C-1, D-4
- A-2, B-3, C-1, D-4
- A-3, B-1, C-2, D-4
- A-4, B-2, C-1, D-3
Show answer
Answer: A. A-3, B-2, C-1, D-4
Renunciation is a declaration (3), termination is automatic (2), deprivation is a Government order (1) and naturalisation is granted on the Third Schedule conditions (4). The second code swaps renunciation and termination, the third swaps termination and deprivation, and the fourth swaps renunciation and naturalisation.
Q4. Consider the following statements about Overseas Citizen of India (OCI) cardholders:
1. An OCI cardholder can vote in elections to the Lok Sabha.
2. A person whose grandparent was at any time a citizen of Pakistan is not eligible to register as an OCI cardholder.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: an OCI cardholder is a foreign national with no right to vote. Statement 2 is correct: anyone who, or whose parent or grandparent, was ever a citizen of Pakistan or Bangladesh is excluded. So '1 only' and 'both' are wrong, and 'neither' ignores statement 2.
Q5. With reference to the Citizenship (Amendment) Act, 2019, consider the following statements:
1. It covers persons of specified communities from Afghanistan, Bangladesh and Pakistan who entered India on or before 31 December 2014.
2. It applies to the tribal areas of Assam included in the Sixth Schedule.
3. For the persons it covers, the residence required for naturalisation is reduced to five years.
Which of the statements given above are correct?
- 1 and 2 only
- 1 and 3 only
- 2 and 3 only
- 1, 2 and 3
Show answer
Answer: B. 1 and 3 only
Statements 1 and 3 are correct. Statement 2 is wrong: the Sixth Schedule tribal areas of Assam, Meghalaya, Mizoram and Tripura, and Inner Line permit areas, are excluded. Every option that includes statement 2 is therefore wrong.
Q6. Under Article 6 of the Constitution of India, a person who migrated from Pakistan became a citizen without needing registration if he had migrated before
- 1 March 1947
- 15 August 1947
- 19 July 1948
- 26 January 1950
Show answer
Answer: C. 19 July 1948
Migrants who came before 19 July 1948 and had been ordinarily resident since then were citizens without registration. 1 March 1947 is the date in Article 7 for migrants to Pakistan, 15 August 1947 is Independence Day, and 26 January 1950 is the commencement of the Constitution.
Q7. Under Section 6A of the Citizenship Act, 1955, a person of Indian origin who came to Assam from the specified territory on or after 1 January 1966 but before 25 March 1971 and is detected as a foreigner
- is a citizen from the date of entry
- must register and cannot vote for ten years from detection
- can never become a citizen
- can become a citizen only by naturalisation after five years
Show answer
Answer: B. must register and cannot vote for ten years from detection
This middle group must register and loses voting rights for ten years from detection, after which it has the rights of citizens. Citizenship from the date of entry applies to those who came before 1 January 1966; the section does give this group a path to citizenship, so 'never' is wrong; and the five-year naturalisation rule belongs to the 2019 amendment, not Section 6A.
Q8. Which of the following Fundamental Rights are available only to citizens of India?
1. Equality before law (Article 14)
2. Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth (Article 15)
3. Protection of the six freedoms (Article 19)
4. Protection of life and personal liberty (Article 21)
Select the correct answer using the code given below:
- 1 and 4 only
- 2 and 3 only
- 1, 2 and 3 only
- 2, 3 and 4 only
Show answer
Answer: B. 2 and 3 only
Articles 15 and 19 are for citizens only. Articles 14 and 21 protect every person, citizen or foreigner, so any option containing 1 or 4 is wrong.
