Emergency provisions
National emergency (Article 352): grounds, approval, revocation, the 1962, 1971 and 1975 proclamations, and effects on federalism and Fundamental Rights (Articles 358, 359); President's Rule (Articles 356, 357), its time limits and S.R. Bommai (1994); financial emergency (Article 360); and a comparison of the three.

Exam traps
- Since the 44th Amendment the third ground for a national emergency is 'armed rebellion', not 'internal disturbance', and the President acts only on the Union Cabinet's written decision.
- A national emergency needs approval within one month by a special majority in each House, but the Lok Sabha alone can force its revocation by a simple-majority resolution; the Rajya Sabha has no such power.
- Article 358 suspends Article 19 only in an emergency declared for war or external aggression, not for armed rebellion; under Article 359 the enforcement of Articles 20 and 21 can never be suspended.
- A national emergency does not dismiss State governments; Parliament may legislate on State List subjects, but those laws lapse six months after the emergency ends.
- Do not carry the national-emergency rules over to Article 356: here Parliament has two months and needs only a simple majority, the outer limit is three years, and going past the first year requires two things together, a national emergency in force and a certificate from the Election Commission.
- A trap option may say the High Court is suspended during President's Rule; it is not, since Article 356 excludes its powers. Also, Bommai (1994) means the assembly is to be held in suspension, and dissolved only after both Houses have approved the proclamation.
- Article 360 has never been used. Once Parliament approves it, a financial emergency runs with no upper time limit, and it is the only emergency under which the pay of Supreme Court and High Court judges can be reduced.
- Count the national emergencies carefully: proclamations were issued in 1962, 1971 and 1975, and the 1975 proclamation came while the one from 1971 had not yet been revoked, so two were in force together.
Recap
- Part XVIII (Articles 352–360): national emergency, President's Rule, financial emergency; suspension of rights modelled on the Weimar Constitution.
- Article 352: war, external aggression or armed rebellion (44th Amendment); Cabinet's written decision; whole or part of India.
- Approval within one month by special majority; six months at a time; revocation by a Lok Sabha simple-majority resolution; one-tenth of members can demand a special sitting within 14 days.
- Proclamations: 1962 (China), 1971 (Pakistan), 1975 (internal disturbance); the last two revoked in March 1977.
- Effects: Articles 353, 250, 354; Lok Sabha term extendable one year at a time; Article 358 (Article 19) and Article 359 (never 20 and 21); ADM Jabalpur (1976) overruled in Puttaswamy (2017).
- Article 356: Governor's report or otherwise; approval within two months by simple majority; six months at a time, maximum three years; Article 357 for law-making and spending.
- S.R. Bommai (1994): judicial review, floor test, no dissolution before Parliament's approval; Rameshwar Prasad (2006); Sarkaria and Punchhi: last resort.
- Article 360: financial emergency, approval within two months, no maximum period, salary cuts including judges, never used.
Practice questions
Q1. Consider the following statements about a national emergency under Article 352:
1. 'Internal disturbance' is at present one of the grounds on which it may be proclaimed.
2. It may be proclaimed for only a part of the territory of India.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: the 44th Amendment (1978) replaced 'internal disturbance' with 'armed rebellion'. Statement 2 is correct: since the 42nd Amendment a proclamation may cover a part of India. So '1 only', 'both' and 'neither' are wrong.
Q2. A proclamation of national emergency must be approved by each House of Parliament:
- Within one month, by a special majority
- Within two months, by a simple majority
- Within one month, by a simple majority
- Within six months, by a two-thirds majority of total membership
Show answer
Answer: A. Within one month, by a special majority
After the 44th Amendment, each House must approve within one month by a majority of its total membership and two-thirds of members present and voting. Two months with a simple majority is the rule for President's Rule and financial emergency; a simple majority is not enough for Article 352; and six months is the period for which an approved proclamation runs, not the approval deadline.
Q3. Consider the following statements:
1. Article 358 suspends the freedoms of Article 19 during a national emergency declared on the ground of armed rebellion.
2. Under Article 359, the President cannot suspend the enforcement of the right to life and personal liberty under Article 21.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: B. 2 only
Statement 1 is wrong: after the 44th Amendment, Article 358 operates only in an emergency declared for war or external aggression. Statement 2 is correct: the same amendment put Articles 20 and 21 beyond the reach of Article 359. So '1 only', 'both' and 'neither' are wrong.
Q4. What is the maximum period for which President's Rule under Article 356 can remain in force in a State?
- One year
- Two years
- Three years
- There is no maximum
Show answer
Answer: C. Three years
Article 356(4) allows six-month extensions up to three years. One year is only the point beyond which the 44th Amendment's two extra conditions apply; two years has no basis in the Article; and 'no maximum' describes a national or financial emergency, not President's Rule.
Q5. Match List I with List II:
List I (Case)
A. ADM Jabalpur v. Shivkant Shukla (1976)
B. S.R. Bommai v. Union of India (1994)
C. Rameshwar Prasad v. Union of India (2006)
D. K.S. Puttaswamy v. Union of India (2017)
List II (Holding)
1. The 2005 dissolution of the Bihar assembly was unconstitutional
2. Habeas corpus petitions could not be pursued while the 1975 order under Article 359 was in force
3. A proclamation under Article 356 is subject to judicial review and majority is tested on the floor of the House
4. The view taken in ADM Jabalpur was wrong and stands overruled
Select the correct answer using the code given below:
- A-2, B-3, C-1, D-4
- A-3, B-2, C-1, D-4
- A-2, B-1, C-3, D-4
- A-4, B-3, C-1, D-2
Show answer
Answer: A. A-2, B-3, C-1, D-4
ADM Jabalpur dealt with habeas corpus in the 1975 emergency, Bommai with judicial review of Article 356 and the floor test, Rameshwar Prasad with the Bihar dissolution, and Puttaswamy overruled ADM Jabalpur. The second code swaps A and B, the third swaps B and C, and the fourth swaps A and D.
Q6. Consider the following statements about a financial emergency under Article 360:
1. Once approved by Parliament, it continues until revoked, without repeated approval.
2. During it, the salaries of judges of the Supreme Court and the High Courts may be reduced.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: C. Both 1 and 2
Both statements are correct under Article 360: there is no maximum period or need for renewal once approved, and clause (4) allows salary cuts that include Supreme Court and High Court judges. So '1 only', '2 only' and 'neither' are wrong.
Q7. The President must revoke a proclamation of national emergency if:
- The Lok Sabha passes a resolution disapproving it by a simple majority
- The Rajya Sabha passes a resolution disapproving it by a special majority
- A majority of State legislatures pass resolutions against it
- The Inter-State Council recommends revocation
Show answer
Answer: A. The Lok Sabha passes a resolution disapproving it by a simple majority
Article 352(7), added by the 44th Amendment, binds the President to revoke when the Lok Sabha disapproves by a simple majority. The Rajya Sabha has no such power, State legislatures play no part in revocation, and the Inter-State Council is only advisory.
Q8. Consider the following statements about a national emergency:
1. Parliament may make laws on subjects in the State List while it is in force.
2. Laws so made continue in force indefinitely after the emergency ends.
Which of the statements given above is/are correct?
- 1 only
- 2 only
- Both 1 and 2
- Neither 1 nor 2
Show answer
Answer: A. 1 only
Statement 1 is correct under Article 250. Statement 2 is wrong: such laws cease to have effect six months after the emergency ends, except for things done before. So '2 only', 'both' and 'neither' are wrong.
